By accessing Easy Market services, the User agrees to be subject to the following General Conditions and Privacy Policy.

Content and use of Easy Market website

The terms of booking and purchase of the products and services available on Easy Market website are governed by the terms and conditions of the contract with the suppliers of the products and services. To finalize the booking/purchase, each user shall acknowledge and accept these General Conditions.
The collection, processing and any other operations in relation to the data collected in connection with the purchase shall comply with the Privacy Policy and the General Conditions. The User agrees to use Easy Market, Easy Market tools and services exclusively for legal purposes, in compliance with the General Conditions and the contract terms which govern the supply of services.

The Travel Agent purchasing through EM Revolution acknowledges that travel to Cuba by US citizens and residents is subject to US laws relating to the US embargo on Cuba and therefore requires a US government license. No refunds or compensation will be made in connection with any travel arrangements made by citizens or residents of the United States without the required licenses.

The parties declare that they will comply with all applicable Indian laws and the requirements of the Foreign Exchange Management Act, 1999, including the collection of PAN Details of all Indian customers who would use hotel facilities abroad and whose transactions are subject to reporting under the Liberalized Remittance Scheme.

Terms and Conditions: Scheduled flights

Easy Market acts exclusively as an intermediary of products and services.

The travel agency shall acknowledge that Easy Market is the intermediary in the provision of scheduled flights. The travel agency shall also acknowledge that this shall not be construed as distribution of travel packages and that it is subject to the terms and conditions of the single service offered with this contract. Moreover, the travel agency shall acknowledge the terms and conditions of carriage for passengers and baggage applicable by the selected airline.
The booking and/or combination of flights and other products and/or services supplied by Easy Market is at the discretion of the final client, who is therefore responsible for such combination.

The user shall be solely responsible for errors in the personal data shared during the booking process and Easy Market shall not be deemed liable in any case.

As a consequence, only the user shall be liable for any error in the insertion of personal data. Easy Market acts as an intermediary in the process of realizing the sale of flight tickets on behalf of airlines. With reference to the product FLIGHTS, Easy Market acts as an intermediary of the airlines in the sale of the flight ticket.
Prior to the issuance of flight ticket, the flight fare can be subject to changes. Easy Market is not responsible for the obligations undertaken by the suppliers of the travel products/services, but is solely responsible for the obligations arising out of its role as intermediary and in any case within the limits for such responsibility provided by articles 1, no. 3 and no. 6, from 17 to 23, from 24 to 31 of the Law No. 1084 of 27.12.1977 ratifying and implementing the relevant International Convention on Travel Contracts (CCV) executed in Brussels on 23.4.1970 (only in relation to the provisions which do not refer to the contract of sale of touristic packages and until its abrogation pursuant to article 3 of Legislative Decree no. 79 of 23 May 2011 – Tourism Code) and article 51, paragraph II, articles 62 and 65 of the Italian Legislative decree no. 21 of 21.02.2014, enforcing the European Directive 2011/83/UE on consumer rights in relation to passengers carriage.
Easy Market, as an intermediary of travel services, shall not be deemed liable for any total or partial violation of the contract executed between the clients and the supplier of the products and/or the services in relation to travels and accommodations. Travel agencies represent and warrant to keep Easy Market, its affiliates, subsidiaries, representatives, employees, contractors and business partners fully indemnified and to hold them harmless against any causes of action and damages, including any legal fees, arising out of the use of the products and/or services purchased on the website.
Easy Market does not guarantee any baggage allowance which is only subject to the terms discretionally applied by the airline company and shall be verified directly with the airline, which may not include it in the ticket fare. The authorization and conditions are determined by the airline. In compliance with applicable laws, travel agencies shall indemnify and keep Easy Market harmless in relation to potential delays, damages or loss in relation to transports, cancellation of flights or other inconvenience caused by the airlines also in compliance with Regulation 261/04/CE which sets forth common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights.

Information available on the website

The intermediary shall use reasonable endeavour to make sure that the information available on the website are accurate and updated. However, the information available on the website are provided by third parties suppliers. Therefore, subject to applicable laws, the intermediary shall not be considered responsible for the accuracy of the information.

Travel documents

The travel agent shall make sure that the user holds valid ID document, visa and health provisions necessary to entry the destination country. It is the user sole responsibility to comply with the laws and regulations of the departure, transit and destination countries. Easy Market waives any liability arising from or related to the absence of any such requirements. During the booking process, specific attention must be paid in filing in the passengers’ names and family names, that must exactly match those stated in the ID document. Airlines accepts to board only passengers whose personal details are displayed on the ticket. Whether boarding is denied as a consequence of the absence or of the possession of invalid documents, the passenger shall not be entitled to any refund. The passenger only is responsible for the possession of valid travel documentation. For more information on passport and visa information and requirements to access the country of destination, we strongly recommend that you visit the Ministry of Foreign Affairs website of the nationality or place of residence of the passengers before finalizing the purchase.

Ticket collection, check-in and boarding

The passengers shall comply with the check-in by the time stated by the airline and in possession of a valid passport. It is recommended to proceed to check-in at least 2,5 hours before flight departure time. If the flight destination is the USA, passengers are recommended to check-in at least 3 hours before flight departure time and to proceed to gates. Information on the flight departure time is available on the booking; in the event of delay in the check-in, in reaching the gate or in the absence of the required travel documentation, the airlines are entitled to refuse boarding and the flight departure shall not be delayed. Easy Market waives any liability and the passenger shall bear all responsibilities and costs or damages suffered as a consequence of the foregoing.

E-tickets

E-tickets are automatically sent by the airlines and identified through a PNR (Passenger Name Record). Once the booking is finalized, the PNR is sent by the airline via email to the address provided with the booking.
We remind you that flight tickets are valid for a year from the date of issue. The expiration of this period makes it impossible to use the ticket and/or to apply to it any type of variation and/or refund.

Changes and Cancellation

The User can cancel or modify the Booking, sending a request to EM via email to voli@easymarketcrs.it or contact EM by Zendesk form.
Once the email is received, Easy Market shall verify if the specific airlines allows changes and/or cancellation in accordance with the fare’s rules communicated by the airline at the time of purchase of the tickets.
If changes and cancellations are allowed, information on possible penalties and applicable fares are disclaimed. Tickets are issued in the name of the person and cannot be assigned to third parties. If the passenger’s name is not correct, changes to the name details may not be allowed and it may be necessary to cancel the ticket and purchase a new one. Certain bookings cannot be changed. Easy Market is not responsible if the passengers name is not correct.

Ticket cancellation within the day and replacement with a different PNR:

The final client or the travel agent must ascertain with Easy Market, under their sole responsibility, that the booking can be cancelled at no additional costs. If yes, a new booking shall be finalized at the available fares, obtained opting out for a new PNR. To this purpose, the travel agency shall insert the following note:
“Please proceed with the cancellation of the following PNR …….. “, by inserting the details of the PNR to be cancelled. Alternatively, cancellation may be required also by email. Please make sure that you receive an email confirmation of such request confirming the cancellation and that the PNR has been “Flew”, meaning not effective anymore. Please adopt this procedure to avoid mistakes.

Refunds

The airline discretionally decides on tickets’ refunds and relevant timing. If the amount has been paid by credit card, the amount of the ticket price shall be credited on the same credit card used for the purchase. If the amount has been paid by bank transfer, the client service shall get in touch with the final client to obtain the bank account details. Agency costs and the possible insurance costs cannot be refunded.

Flight segments

Flight segments shall be used on a continuous basis. In the absence of the foregoing, the whole itinerary can be automatically cancelled and the ticket shall not be refunded.

Additional requests

Any additional request such as boarding pets, special assistance for passengers with disability, boarding weapons, sport equipment, unaccompanied
minors and any other specific boarding request can be presented at the time of the booking or at the time of the flight ticket issuing.
In any event, the request will be submitted to the airline only at the time of the request to issue the flight ticket. It will be airline
discretional decision to agree on the request of additional service. For Easy Market to issue the ticket, the airline shall confirm accordingly.
Sometimes the airline is free to apply additional costs at the airport facilities. In the absence of airline confirmation, Easy Market shall notify
you before issuing the ticket and you can choose to confirm the issue or request
cancellation of the booking.

Unaccompanied minors

Each airline applies its own procedures and rules on unaccompanied minors. Usually the minor shall be accompanied by a supervisor, who shall present himself as such at check in and boarding. The supervisor shall be over 18 years old and, if the supervisor is not one of the minor’s parents, shall be the tutor or other person having parental authority who shall have a valid proxy and the travel documents required for the same travel of the minor and travel on the same flight. Easy Market is not responsible for issues arising out of violations of rules and policies on boarding of unaccompanied minors. In any case, it is the passenger sole responsibility to acknowledge the airline rules and policies on boarding of unaccompanied minors. The passenger will be liable for any damage or cost arising out of violations of rules and procedure on boarding unaccompanied minors.

With reference to Low Cost Flight bookings, please note that Revolution is a technological system that makes the contents of airlines belonging to this type available: however, operating as an intermediary and unable in any way to interfere with the policies applied by carriers, please refer to them for the confirmation and management of reservations; for this reason strongly recommend to read in advance the Terms and Conditions of each selected company.

The total cost indicated on Revolution may include ticking fees applied by our suppliers, that in case of cancellation will not be refundable.

In case of cancellation of the reservation, the refundable amounts may differe from that indicated at the time of issuing due to the currency exchange rate which, although not visible on Revolution, is regulated between Easy market and its suppliers.

The aforementioned terms and conditions are therefore understood to be accepted at the time of booking, unless otherwise communicated.

Travel documents

Easy Market waives any liability for any breaches in relation to any of the following requirements.

  • During the booking process, specific attention must be paid in filling in the passengers’ names and family names, that must exactly match those stated in the ID document. Airlines accept to board only passengers whose personal details are displayed on the ticket.
  • Whether boarding is denied as a consequence of the absence or of the possession of invalid documents, the passenger shall not be entitled to any refund. The passenger only is responsible for the possession of valid travel documentation.
  • For more information on passport and visa information and requirements to access the country of destination, we strongly recommend that you visit the Ministry of Foreign Affairs website of the nationality or place of residence of the passengers before finalizing the purchase.

Check-in online

ATTENTION: some low cost airlines mandatorily requires to check in online within a specific time prior to departure.
Passengers who do not show the boarding pass printed online to the airport security staff and at the gate shall check in again at the airport (if possible) and shall pay an additional amount as required by the airline.
The airlines which mandatorily require the check in online are indicatively: Ryanair, Volotea, Wizz Air e Bluair.

E-tickets

Tickets’ issuing

Low cost airlines usually use e-tickets. This means that no paper ticket will be printed, but when the booking is finalised, you will receive a confirmation
email with the booking number of your low cost flight. Please print this email and show it together with your ID document when you check in.
Please note that for all Ryanair flights it is mandatory to check in online directly on Ryanair website
and print the boarding pass to be shown at the airport; to this end, please read carefully on Ryanair website the time frame within which it is
mandatory to print the boarding pass, given that after such deadline the airline provides for a penalty to be paid by the passenger.

Ticket charge

We inform you that the flight ticket will be charged by two separate transactions. Low cost airlines shall charge the ticket (ticket price, airport taxes, hold baggage’s fare and possible surcharges for the credit card) while Easy Market, acting as intermediary, shall charge the service tax and possible optional travel insurance (if requested). In the bank statement, therefore, you will notice two separate charges, but the sum of the two will exactly correspond to the whole amount as stated in your confirmation email.

Cancellation

Low cost tickets are usually non-refundable except when the airline cancels or significantly delays the time for departure. For more information please read the terms and conditions of each airline. It is advisable for passengers who book some time in advance to confirm the booking between 24 and 72 hours before departure, by directly accessing the selected airline’s website.

Change of names

Any change of name is allowed by paying a penalty imposed by the low cost airline in addition to the payment of the difference between the original amount paid and the minimum fare available at the time of the change. In any event, changes of names shall be directly requested to the low cost airline.

Change of date, time and itinerary

The date, time and itinerary can be modified if there is availability and upon payment of a penalty for the change, in addition to the payment of the difference between the original amount paid and the minimum fare available at the time of the change. If the total fare is lower than the one originally paid, no refund is provided. In any event, the changes shall be directly requested to the low cost airlines.

Safety rules for hand baggage

From 6 November 2006, the European Union has adopted new safety rules which limit the quantity of liquid which are allowed through and after the security checks at the airport. Passengers are allowed to carry only small amounts (max. 100 ml for each container) of liquids, gel, creams and gas as hand baggage and these shall be put in a transparent plastic bag which cannot exceed 1 litre (with dimensions equal for example to approximately cm 18 x 20). Medications and liquid prescription dietary products, as well as food for infants, are not subject to volume restrictions and are not required to be placed in the plastic bag. Easy Market is not responsible for issues arising out of violations of rules and policies on boarding of unaccompanied minors. In any case, it is the passenger sole responsibility to acknowledge the airline rules and policies on boarding of unaccompanied minors. The passenger will be liable for any damage or cost arising out of violations of rules and procedure on boarding unaccompanied minors.

Terms and Conditions: Hotels

 

Article 1 Definitions

Easy Market: provider of the Revolution booking system
Travel Agency: user of the Revolution booking system
Supplier: reseller of the travel service
Accommodation faciltiy/hotel structure: supplier of the product and/or travel service

Article 2 Products and services

In this Hotels section, the Travel Agency can exclusively purchase hotel services consisting of stays at accommodation facilities. Any services/mandatory fees to be purchased/settled directly on site are excluded, unless otherwise specified.

Article 3 Easy Market’s role

Easy Market acts exclusively as an intermediary of individual travel services and the simultaneous booking and/or combination of hotel services and additional and different products and/or services, including of an ancillary nature, which can be purchased in another section of the booking system, is at the full discretion of the Travel Agency, which shall assume all responsibility, including as an organiser, arising out of any combination thereof.
Easy Market, in its capacity of intermediary, shall not be responsible for the obligations of the supplier/accomodation facility/third party suppliers of ancillary products and services relating to the supply and execution of the services and/or products purchased and shall not be liable for the breaches of such subjects, but shall be solely responsible for the obligations relating to its status as an intermediary and, in any case, within the limits established by law. Where the ancillary products and/or services are purchased directly by the end customer from the accommodation facility or from third party suppliers of the latter, Easy Market shall not in any way and in any capacity be responsible for the supply and execution of such products and/or ancillary services.

Article 4 Type of booking

By accessing the Hotel section of the Revolution booking system, the agent expressly acknowledges that the same can and should only be used for individual bookings. Group bookings are not allowed. Group bookings shall refer to those bookings made by the agency, including not at the same time, for stays at the same accommodation facility, on the same dates (check in-checkout), which considered as a whole includes a minimum of 15 guests or more, regardless of the number of rooms booked. The agency also acknowledges and expressly accepts that individual bookings made at the same hotel in the same period (check in-checkout) could be considered by the accommodation / provider / Easy Market as “group bookings” regardless of the number of rooms booked, number of people and/or date of booking. In relation to such reservations, the accommodation facility and/or the supplier expressly reserve the right to reconfirm and/or adjust the price and/or modify the conditions of sale or cancel them, even with the possible application of a penalty which will remain the responsibility of the booking travel agency.

Article 5 Holding Space / Blocking spaces

The booking agency is absolutely forbidden from using the Revolution Hotels section for blocking rooms for future sales (blocking spaces). Easy Market and its Suppliers and/or hotels reserve the right to cancel, change the conditions and sale price of any reservation identified, at their sole discretion, as relating to blocking spaces, without this involving any of the same obligations or responsibilities.

Article 6 Prices – Errors in the contents of the system

The travel agency acknowledges that the information and prices shown within the Revolution platform may be incorrect and/or inaccurate.
Any error in connection with the information/descriptions, the terms of sale and the prices charged (including errors relating to content/print, topographical errors, errors in the calculation of currency conversions, errors in price in general, etc.) shall not in any way be binding for Easy Market and its suppliers and/or the accommodation facilities.
The travel agency acknowledges that as acquired from third parties, the product and/or service descriptions, the terms of sale and the prices charged are subject to change at any time without notice.
Under these assumptions, Easy Market and its suppliers and/or accommodation facilities reserve the right to cancel reservations made by the agency, which acknowledges and expressly accepts that in case of cancellation the travel agency and/or the end customer shall be entitled only to a refund of the price already paid and collected, with the express waiver to request any additional compensation or reimbursements.
Once the error has been detected, without acknowledgments and/or obligations of any kind, Easy Market reserves the right to propose alternatives, where possible, at the same cost. Any extra costs shall, in any case, be borne by the agency and/or customer.

Article 7 Taxes

Unless otherwise specified, the hotel rates available on the Revolution platform typically include the following types of taxes: state, federal, municipal.
By way of example and not limited to, the following types of taxes are always excluded from the final price and must be paid on site by customers/guests
(unless expressly or otherwise indicated in the policies of the hotel structure booked): the following types of tourist taxes: (by way of example but not exhaustive),
e.g. in Italy: Rome, Naples, Rimini, Siena, Florence, etc. and abroad in the USA), resort fees, etc.
All additional costs shall be charged to customers/guests or may not be requested in any way or for any
reason from Easy Market and / or to the supplier and / or hotel structures.
It should be noted that in relation to duties and taxes and other taxes to be paid locally, since the relative amounts are imperatively decided by the local authority without any obligation of publicity or prior notice and are sometimes not easy to obtain, Easy Market, despite carrying out continuous and periodic checks with the suppliers of the accommodation facilities, cannot be held liable in the event of a sudden deviation of such public charges from the time of its offer.

Article 8 Payments

The Agency is required to pay the prices of the tourist products and services booked and the management fees for individual bookings, when requested by Easy Market, and in any case before the start of the booked stay and/or service (unless otherwise agreed upon in writing with Easy Market).
Failure to pay within the terms indicated above and/or agreed upon (if prior to the start of the stay and/or service) shall result in the cancellation of the booking, with application of penalties, as also applied by the supplier/accommodation facility/third party provider of the service and/or ancillary product, which shall remain the responsibility of the travel agency.

Article 9 Customer’s age

The agent acknowledges that all bookings made in the Hotels section of the Revolution system require that at least one of the guests for each room booked are 18 years of age or older, in any case exempting and holding Easy Market harmless from any consequence connected to the non-observance of this condition.

Article 10 Names

All bookings made in the hotel section of the Revolution system, require the insertion in the appropriate forms of the name and surname of all guests (name indicated in the guest’s identification document) who will be part of the stay. Abbreviations, partial names or made up names may be rejected by the hotel structure, resulting in the cancellation of the reservation.
The travel agency shall take note of the above and expressly accepts that Easy Market and its suppliers and/or accommodation facilities cannot in any way be considered responsible for any inconveniences and/or disruptions related to the incorrect insertion of names during the booking phase.

Art. 11 Bed Configuration

The agency hereby acknowledges and accepts, without raising any objections, that:

  • The types of rooms booked (single, double, triple, etc.) are not guaranteed and may vary by hotel structure, subject to availability at check-in.
  • In the case of bookings with “children” (infant: 0 to 2 years of age, child: 2 to 11 years of age or 2 to 17 years of age, depending on the supplier and on the accommodation facility and not determinable during the booking phase), it is up to the supplier and/or to the accommodation facility to accommodate the child in pre-existing beds or to eventually confirm an extra-bed at check-in, with a supplement that remains the responsibility of the customer. Moreover, in case no extra charge was applied to the extra-bed, an extra charge may be requested on site, which shall be charged to the customer, for the child’s breakfast and meals.

Article 12 Customer requests:

  1. Requests made by the customer (by way of example but not limited to):
    • Smoking/non smoking rooms
    • Rooms located on upper/lower floors
    • Rooms not located on the ground floor
    • Honeymoon stays
    • Rooms close to each other or adjoining rooms

    Such requests are not guaranteed and shall be considered as mere considerations that Easy Market shall send to the supplier. The accommodation facility reserves the right to accept or refuse the request, at its sole discretion and subject to availability. The agency takes note of the above and expressly agrees that in no event shall Easy Market be held liable for the accommodation facility’s failure to accept the specific preferences expressed by the customer.

  2. Customer requests that require written confirmation (by way of example but not limited to):
    • Rooms for disabled guests
    • Guests travelling with pets
    • Confirmation of a double bed or two single beds
    • Cribs

    This type of service requires written confirmation from the supplier of the requested service. Easy Market shall bring the request to the attention of the supplier and shall communicate to the agency any tariff adjustments or supplements to be paid, which, in any case, shall remain the responsibility of the customer.

Article 13 Credit card as guarantee

The hotel structures reserve the right, including in the case where the price of the stay has already been settled, to request a credit card to guarantee the reservation and any damage to the structure, as well as for the payment of any extras and/or taxes to be paid on site.
In the event that customers are not credit card holders or refuse to provide a credit card for such purposes, the hotel structure reserves the right to cancel the reservation. Easy Market and its suppliers shall not be liable for any inconveniences and/or damages arising from the foregoing.

Article 14 Changes and cancellations

In case there is a need to make changes or to cancel the services and/or products booked through the Revolution system, the Agency shall have to make said request to Easy Market by sending an email to:

Upon receipt of such notification, the relevant department shall verify if changes and/or cancellations are allowed for the specific service and/or product purchased.
If such changes and/or cancellations are allowed, according to the contractual conditions established in the information for the products and/or services booked, provided to the Agency at the time of purchase, any supplements and/or penalties applied that shall be charged to the Agency will be communicated.

Article 15 Late arrival (no show):

In case of expected arrival at the accommodation facility after the check-in time indicated in the booking documents, or, in the absence of an express indication, after 8:00 PM on the day of the beginning of the stay, the agency and/or the end customer shall be required to give notice to the structure. In case of failure to notify the structure in this regard, the hotel reserves the right to mark the non-arrival at the times indicated as a “no show” on the part of the customers, cancelling the reservation, resulting in unavailability of the room and charging a penalty in the amount of 100% of the price of the stay, which shall remain the responsibility of the Agency and/or customer.
The agent acknowledges and expressly accepts that Easy Market has no decision-making power in this respect and therefore cannot be held responsible in case of cancellations or disruptions.

Article 16 Refunds

In the case of refunds, if payment for the product and/or service was made using a credit card, the amount, less any expenses and without interest, shall be refunded directly to the same credit card, if allowed by the payment circuit used. The amount shall show up on the customer’s bank account 2/3 months following the request. Alternatively, Easy Market shall contact the Agency directly to define the reimbursement mode.
If payment was made by bank transfer (only possible for hotel stays), the Agency shall be contacted by our Customer Service department for communication of the bank details to be used to process the refund.

Article 17 Documents

It is the Agency’s responsibility to ensure the their customer is in possession of valid identity documents, visas and health requirements necessary to enter the countries included in the itinerary. Easy Market declines any responsibility for non-fulfilment due to the absence of such documents.

Article 18 Referral

For any matters not covered by this document, reference shall be made to the supply contract of the Revolution booking system entered into with the agency and any eventual addendums to the agreement in question, to be understood here as fully incorporated.

Terms and Conditions: Excursions and transfers


Easy Market
acts exclusively as an intermediary for products and/or services.
The hotel reservation and/or the combination of hotels and the various products and/or services offered by Easy Market is at the full discretion of the client Agency, which therefore assumes all responsibility arising from the possible combination of the same.
The hotel service, as well as excursions and transfers, are not configurable as negotiable elements for the organisation of travel packages and are therefore governed by the terms and conditions of the individual service covered by the agreement, as specified below.
Easy Market shall not, in any case, be responsible for incorrect personal data entered by the customer during the purchase process.
The Agency is therefore responsible for the consequences deriving from the incorrect insertion of said data.
In this scenario, with regard to the Hotel, Excursions and/or Transfer products, Easy Market shall act as an intermediary of the various suppliers exclusively in the sale of hotel accommodations or ancillary services.
Easy Market also acts as an intermediary for products and/or services in relation to the sale of other ancillary and optional services, so-called activities
(e.g. tourist guides, shows, sporting and recreational events in general, catering, cultural services, etc.) and so-called transfers (from and to hotel or airport or other travel station),
, available for purchase by the end customer separately and provided directly by the hotel or by its third party suppliers, according to the contractual conditions established in the purchase form provided by the hotel or by the latter’s third-party suppliers to the end customer, as these are not configurable as negotiable elements for the organisation of travel packages and Easy Market shall not in any way be liable for the supply and execution of such activities or transfers.
Easy Market shall not, in any case, be responsible for the obligations imposed on suppliers of individual products and/or services, but shall be solely responsible for those arising from its capacity as an intermediary and, in any case, within the limits established by law pursuant to Articles 1, no. 3 and no. 6, from 17 to 23 and from 24 to 31 of Law no. 1084 of 27/12/1977, ratifying and implementing the
International Convention on Travel Contracts (CCV) signed in Brussels on 23/04/1970 and  Legislative Decree 62/2018 implementing Directive (EU) 2015/2302.
Easy Market, acting as an intermediary, shall not be liable for the total or partial non-performance of trips, holidays or other products and/or services covered by the agreement concluded between the customer and the supplier of the relative products and/or services.

Changes and cancellations

In case of the need for changes or cancellations of hotel accommodation and/or ancillary services (activities or transfers), the Agency shall have to make the request to Easy Market by sending an email hotel@easymarketcrs.it or contact Easy Market by Zendesk form.
Upon receipt of such notification, the relevant department shall verify if changes and/or cancellations are allowed for the specific hotel reservation, excursion or transfer purchased.
If such changes and/or cancellations are allowed, according to the contractual conditions established in the information provided by the hotel or by the service, at the time of purchase, any penalties applied by the hotel provider shall be communicated.

Refunds

If payment was made by credit card, the amount shall be refunded directly to the credit card used to place the order, depending on the payment system used. The amount shall show up on the customer’s bank account 2/3 months following the request.
If payment was made by bank transfer (only possible for hotels), the Agency shall be contacted by our Customer Service department for communication of the bank details to be used to process the refund.

Documents

For the AUTO service, Easy Market acts as an intermediary between the MicronNexus GmbH car rental company, partner in the provision of car rental service and the customer.

Payment of the car rental service

The charge shall be made through the Revolution.travel website, for the full amount of the car rental. The cost of any extra services reserved must be paid on site.

Documents required to pick up a car

In order to pick up the car, the customer must present the following documents:

  • Valid credit card used at the time of booking and in the name of the person who will pick up the car, with a credit limit high enough to make the required payment. ATM or debit cards are not valid for this purpose. It is mandatory that the person who picks up the car is the same person who made the reservation. Cars will not be rented to anyone who is not in possession of a valid credit card.
  • Voucher relating to the car rental reservation: after the booking is completed, a confirmation email will be sent with the booking code, at the email address specified at the time of booking. The customer shall receive confirmation of their car rental company within two working days. From this email, the customer will be able to check the status of the reservation by clicking on a link which will open a page with their voucher, which must be printed and presented when picking up the car.
  • Valid driver’s license: drivers must be in possession of a valid driver’s license for at least 1 year and must not have committed any serious traffic offenses.
  • A valid identification document

Easy Market declines any responsibility for non-fulfilment relating to the absence of any of the abovementioned documents or for the presentation of an invalid document.

Contents and Use of Easy Market “Revolution” Website

The booking and purchase of the products and services available on the Easy Market website are governed by the contractual conditions applied by the suppliers of such products and services. Each Client Agency is required to know and accept these General Conditions before proceeding with any booking and/or purchase. The collection, processing and any other operation relating to the information provided during the purchasing process are carried out in accordance with the Privacy Policy, which forms an integral part of these General Conditions.
The Client Agency undertakes to use Easy Market, its functionalities and its services exclusively for lawful purposes, in compliance with these General Conditions and with the contractual conditions governing the provision of services.
No booking, payment or any other activity relating to travel services to Cuba shall be facilitated, organised or carried out by or through any natural or legal person residing in the United States unless authorised under U.S. sanctions laws. The travel agency purchasing through EM Revolution acknowledges that travel to Cuba by U.S. citizens and residents is subject to U.S. laws relating to the U.S. embargo on Cuba and therefore requires a licence issued by the U.S. Government. No refunds or compensatory reimbursements shall be issued for any travel arrangements made by U.S. citizens or residents without the required licences.
The parties declare that they comply with all applicable Indian laws and with the requirements of the Foreign Exchange Management Act, 1999, including the collection of PAN details from all Indian customers who use hotel facilities abroad and whose transactions are subject to reporting under the Liberalized Remittance Scheme.

Premise

The services available for purchase on the website easymarketspa.paquetedinamico.com (hereinafter “General Conditions”) are offered by EASY MARKET and may be booked exclusively through the sales platform called Revolution, owned by Easy Market Spa.
EASY MARKET operates both as an intermediary in the sale of services and/or travel packages offered by other suppliers/tour operators, and as a tour operator itself, in compliance with all applicable laws and regulations.
The liability of EASY MARKET and of the travel agency is governed by the rules referred to below.
EASY MARKET is a company operating in the tourism sector, carrying out the production, organisation and intermediation of travel and accommodation services, as well as any other form of tourism service provided to clients. EASY MARKET provides an innovative online booking website; booking of land and air transportation; booking of hotel and similar accommodation; booking of tourist, sports, recreational and experiential activities; booking of car rentals and other individual or collective means of transport.
Through the Website, EASY MARKET provides the Client Agency—based on the online requests and searches carried out by the latter—with a travel proposal, services or travel packages, upon payment of a fee for the service provided. Contracts relating exclusively to the offer of a transport service, accommodation service or any other separate tourist service do not constitute a travel package and do not fall within the definition of an organised travel arrangement. Consequently, they do not benefit from the protections provided by the Tourism Code, and the contractual conditions of the individual supplier shall apply. Responsibility for the proper performance of the contract lies solely with the service provider.
If a booking made through access to the VOLO+HOTEL (package) platform is subsequently modified by the Client Travel Agency in such a way that the requirements of Art. 5(1)(c) of these General Conditions are no longer met (by way of example but not limited to: the agency cancels part of the services required to meet the conditions under Art. 33(1)(c) of the Tourism Code, thus creating the conditions for the sale of a simple tourist service under Art. 5(1)(a)), the legal protections for organised travel or package travel will lapse. The contractual conditions of sale of the individual service shall therefore apply, and the travel agency shall be responsible for choosing the supplier in accordance with the criteria of professional diligence under Art. 1176, second paragraph, of the Italian Civil Code, as well as the sales conditions and cancellation penalties applied by each supplier.

1. CONTENT OF THE PACKAGE TRAVEL SALES CONTRACT

In addition to the General Conditions set out below, the following form an integral part of the travel contract: the pre-contractual information referred to in Article 34 of the Tourism Code, the description of the package contained in the online catalogue, or in the travel programme or technical sheet, as well as the documents provided prior to the performance of the package and the booking confirmation of the travel services requested by the traveller pursuant to Article 36 of the Tourism Code.
Access to the travel package through the Website is available by selecting the Flight + Hotel link within the Revolution sales platform, which is reserved exclusively for professionals (travel agencies).

2. LEGISLATIVE SOURCES

The sale of packages concerns the provision of tourist services in Italy and abroad and is governed by Legislative Decree No. 62 of 21 May 2018, implementing EU Directive 2015/2302 on package travel and linked travel arrangements, which amended Annex 1 to Legislative Decree No. 79 of 23 May 2011 (Articles 32–51 novies and Annexes A and B of the Tourism Code); Legislative Decree No. 206 of 6 September 2005 (Consumer Code); the Italian Civil Code for all matters not regulated by the above laws; and Law No. 1084 of 27 December 1977, which ratified the International Convention on Travel Contracts (CCV) of 23 April 1970, until it is repealed upon the effectiveness of the Italian State’s denunciation of such Convention, in accordance with Article 37 thereof.

3. ADMINISTRATIVE REGIME

The tour operator and the retailer of the package to whom the traveller turns carry out their activities in compliance with the national and regional laws applicable in their respective jurisdictions.
The tour operator and the retailer shall inform the traveller of the details of the insurance policy covering civil liability in favour of the traveller for damages arising from the tour operator’s and retailer’s breach of contractual obligations; the insurance policies, bank guarantees, funds, consortia or other forms of protection in cases of insolvency or bankruptcy of the tour operator or retailer, ensuring—without delay upon request by the traveller—the reimbursement of the price paid for the package and the immediate repatriation of the traveller if the package includes transportation, as well as, where necessary, the payment of board and lodging prior to return. All prices are expressed in Euros, unless otherwise stated, and include VAT. In accordance with the VAT regime for travel agencies (Art. 74 ter of Presidential Decree No. 633 of 26 October 1972), invoices issued by EASY MARKET do not show the VAT collected on the services sold.

5. DEFINITIONS

1. For the purposes of this contract, the following terms shall have the meanings set out below:

  1. a) “Tourist service”:
    1. the transport of passengers;
    2. accommodation that does not form an integral part of passenger transport and is not intended for residential purposes or for long term language courses;
    3. the rental of cars or other motor vehicles pursuant to the Decree of the Italian Ministry of Infrastructure and Transport of 28 April 2008, published in the Official Gazette No. 162 of 12 July 2008, or motorcycles requiring an A category driving licence pursuant to Legislative Decree of 16 January 2013, No. 2;
    4. any other tourist service that does not form an integral part of the services listed in points 1), 2) or 3), and is not a financial or insurance service.
  2. b) “Additional tourist service”: Accessory services such as, among others: baggage handling provided as part of passenger transport; use of paid parking at stations or airports; short distance passenger transport during guided tours or transfers between accommodation facilities and travel hubs; organisation of entertainment or sports activities; provision of meals, beverages and cleaning services associated with accommodation; use of bicycles, skis and other equipment provided by the accommodation facility; access to on site structures such as swimming pools, beaches, gyms, saunas, wellness centres or spas, including for hotel guests; any other typical additional service including those customary locally.
  3. c) “Package”: A combination of at least two different types of tourist services for the purpose of the same trip or holiday, where at least one of the following conditions is met:
    1. 1) such services are combined by a single professional, even at the traveller’s request or according to their selection, before a single contract is concluded for all services;
    2. 2) such services, even if concluded with separate contracts with individual service providers, are:
      1. 2.1) purchased at a single point of sale and selected before the traveller agrees to pay;
      2. 2.2) offered, sold or invoiced at an all inclusive or total price;
      3. 2.3) advertised or sold under the term “package” or similar designation;
      4. 2.4) combined after the conclusion of a contract through which the professional enables the traveller to choose from a selection of different types of tourist services, or purchased from different professionals through linked online booking processes where the traveller’s name, payment details and email address are transmitted by the first professional to one or more additional professionals, and the subsequent contract(s) are concluded no later than 24 hours after the confirmation of the first tourist service.
  4. d) “Package travel contract”: the contract relating to the entire package or, if the package is provided under separate contracts, the set of contracts relating to the tourist services included in the package;
  5. e) “Start of the package”: the beginning of the performance of the tourist services included in the package;
  6. f) “Linked travel arrangement”: at least two different types of tourist services purchased for the same trip or holiday, which do not constitute a package, involving the conclusion of separate contracts with individual service providers, where a professional facilitates either:
    1. during a single visit to or contact with their point of sale, the separate selection and separate payment of each tourist service by travellers;
    2. the targeted purchase of at least one additional tourist service from another professional when such purchase is concluded within 24 hours following the confirmation of the first tourist service;
  7. g) “Traveller”: any person who intends to conclude a contract, enters into a contract or is entitled to travel under a concluded contract within the scope of these General Conditions;
  8. h) “Professional”: any natural or legal person, public or private, who acts within the scope of their commercial, industrial, artisanal or professional activity in relation to the contracts governed by these General Conditions, including through another person acting on their behalf or under their responsibility, as tour operator, retailer, facilitator of linked travel arrangements, or provider of tourist services, in accordance with the applicable legislation;
  9. i) “Tour operator”: a professional who combines packages and sells them or offers them for sale directly or jointly/through another professional, or the professional who transmits traveller data to another professional pursuant to letter c), number 2.4);
  10. l) “Retailer”: the professional other than the tour operator who sells or offers for sale packages combined by a tour operator;
  11. m) “Establishment”: the establishment defined by Art. 8, paragraph 1, letter e), of Legislative Decree 26 March 2010, No. 59, i.e. “the actual pursuit for an indefinite season of a non-salaried economic activity by the service provider, carried out with a stable infrastructure”;
  12. n) “Durable medium”: any tool that allows the traveller or the professional to store information personally addressed to them so as to be able to access it in the future for a period of time appropriate to the purposes for which it is intended and that allows identical reproduction of the stored information;
  13. o) “Unavoidable and extraordinary circumstances”: a situation beyond the control of the party invoking such a situation, the consequences of which could not have been avoided even if all reasonable measures had been taken;
  14. p) “Lack of conformity”: a failure to perform the tourist services included in a package;
  15. q) “Minor”: a person under the age of 18;
  16. r) “Point of sale”: any premises, mobile or immovable, intended for retail sales or a retail website or similar online sales tool, even where retail websites or online sales tools are presented to travellers as a single tool, including telephone services;
  17. s) “Return”: the traveller’s journey back to the place of departure or to another place agreed by the contracting parties.
  18. t) “Travel Agency”: a professional holding the legal requirements to carry out intermediation activities in the sale of packages and tourist services.
  19. u) “Client Travel Agency”: a travel agency registered and using the Revolution platform upon signing a supply agreement.
  20. w) “Consumer”: the subject who purchases a package through their chosen travel agency (which uses the Revolution sales platform owned by Easy Market Spa by accessing the package sales platform) for purposes unrelated to their business, commercial, artisanal or professional activity.
  21. Y) “Authentication Credentials”: ID, email and password used by the Client Agency to access the Revolution platform owned by Easy Market.
  22. Z1) “Supplier”: the companies contracted by EASY MARKET that provide the products available online, including through XML integration.
  23. Z2) “Service Provider”: the actual provider of the service contracted by the Supplier or by EASY MARKET.
  24. Z3) “Customer Service”: the booking assistance service provided during EASY MARKET’s working days and hours to the Client Travel Agency.
  25. Z4) “Cart”: the services or travel packages selected by the Client Agency after performing one or more searches on the sales platform.
  26. Z5) “Summary” (page): the page summarising the services added to the cart, selected by the Client Agency; it includes the total price of the services, the method (deposit and balance or balance) and the payment terms.
  27. Z7) “Booking”: an order submitted through the sales platform by the professional.
  28. Z8) “Scheduled flight”: a flight regularly operated by an airline.
  29. Z9) “Low-cost flight”: a flight regularly operated by a low-cost airline that limits included services on the ground and in flight and provides services for a fee (by way of example but not limited to: hand and checked baggage, meals and drinks on board, seat assignment, travelling with animals), some of which cannot be purchased through the Website but only by contacting the carrier and according to the carrier’s own rules, to which reference is made for the general conditions of sale and carriage.

6. PRE-CONTRACTUAL INFORMATION TO THE TRAVELLER

1. Before the conclusion of the package travel contract or a corresponding offer, the tour operator and, where the package is sold through a retailer, the latter shall provide the traveller with the relevant standard information form depending on whether it concerns:

  1. IA – package travel contracts where the use of hyperlinks is possible;
  2. IIA – package travel contracts in circumstances different from those under point I;
  3. IIIA – where the tour operator transmits data to another professional pursuant to Art. 5, paragraph 1, letter c), point 2.4) of these General Conditions;
  4. IB – where the professional facilitating an online linked travel arrangement under Art. 5, paragraph 1, letter f), point 1) of these General Conditions is a carrier selling a return ticket;
  5. IIB – where the professional facilitating an online linked travel arrangement under Art. 5, paragraph 1, letter f), point 1) of these General Conditions is a professional other than a carrier selling a return ticket;
  6. IIIB – in the case of linked travel arrangements under Art. 5, paragraph 1, letter f), point 1) of these General Conditions, where the contracts are concluded with the physical and simultaneous presence of the professional (other than a carrier selling a return ticket) and the traveller;
  7. IVB – where the professional facilitating an online linked travel arrangement under Art. 5, paragraph 1, letter f), point 2) of these General Conditions is a carrier selling a return ticket;
  8. VB – where the professional facilitating an online linked travel arrangement under Art. 5, paragraph 1, letter f), point 2) of these General Conditions is a professional other than a carrier selling a return ticket.

2. In addition to the following information:

  1. a) the main characteristics of the tourist services, such as:
  2. 1) the destination(s) of the trip, the itinerary and the periods of stay with corresponding dates and, where accommodation is included, the number of nights;
  3. 2) the means, characteristics and categories of transport, the locations, dates and times of departure and return, the duration and location of intermediate stops and any connections; if the exact schedule has not yet been determined, the tour operator and, where applicable, the retailer, shall inform the traveller of the approximate departure and return times;
  4. 3) the location, main features and, where applicable, the tourist category of the accommodation according to the regulations of the destination country;
  5. 4) the meals provided;
  6. 5) the visits, excursions or other services included in the total agreed price of the package;
  7. 6) the tourist services provided to the traveller as part of a group and, in such case, the approximate size of the group;
  8. 7) the language in which the services will be provided;
  9. 8) whether the trip or holiday is suitable for persons with reduced mobility and, upon the traveller’s request, detailed information on the suitability of the trip or holiday, taking into account the traveller’s needs;
  10. b) the business name and geographical address of the tour operator and, where applicable, of the retailer, as well as their telephone numbers and email addresses;
  11. c) the total price of the package, including taxes and all duties, fees and other additional costs, including any administrative and file-handling expenses; or, where these cannot reasonably be calculated before the conclusion of the contract, an indication of the type of additional costs the traveller may still have to bear;
  12. d) the payment arrangements, including any deposit amount or percentage of the price to be paid and the timetable for payment of the balance, or the financial guarantees the traveller is required to pay or provide;
  13. e) the minimum number of persons required for the package and the deadline under Art. 41, paragraph 5, letter a) (Tourism Code) before the start of the package for the possible termination of the contract in the event that the minimum number is not reached;
  14. f) general information concerning passport and visa requirements, including approximate timeframes for obtaining visas, and the health formalities for the country of destination;
  15. g) information regarding the traveller’s right to withdraw from the contract at any time before the start of the package, subject to payment of appropriate withdrawal fees, or, where applicable, standard withdrawal fees required by the tour operator under Art. 41, paragraph 1 (Tourism Code);
  16. h) information on the optional or mandatory subscription of insurance covering the traveller’s unilateral withdrawal from the contract or assistance costs, including repatriation, in case of accident, illness, or death;
  17. i) details of the protection provided under Art. 47, paragraphs 1, 2 and 3 (Tourism Code) and, in particular, details of the civil liability insurance policy in favour of the traveller for damages resulting from breach of contractual obligations by the tour operator and the retailer, as well as information on the insurance policies, bank guarantees, funds, consortia or other forms of protection in cases of insolvency or bankruptcy of the tour operator or retailer, ensuring—without delay upon the traveller’s request—the reimbursement of the price paid for the package and the immediate repatriation of the traveller when the package includes transport, and, where necessary, the payment of food and accommodation before return;
  18. l) that the traveller may not invoke any rights that apply exclusively to package travel contracts under the Tourism Code and that each service provider shall remain solely responsible for the proper contractual performance of its own service, while the traveller may invoke insolvency protection under Art. 35 of these General Conditions where a contract giving rise to a linked travel arrangement has been concluded.

7. CONTENT OF THE PACKAGE TRAVEL CONTRACT

  1. 1. The package travel contract shall include the full content of the pre-contractual information referred to in Article 6 of these General Conditions, as well as the following information:
  2. a) the traveller’s specific requests that have been accepted by the tour operator;
  3. b) a declaration stating that the tour operator is responsible for the proper performance of all tourist services included in the contract, and is obliged to provide assistance if the traveller is in difficulty, including in the event of circumstances not attributable to the tour operator. Such assistance shall include, in particular, providing appropriate information regarding health services, local authorities and consular assistance, assisting the traveller in making remote communications and helping the traveller to find alternative tourist services. The tour operator may require payment of a reasonable fee for such assistance if the problem has been caused intentionally by the traveller or through the traveller’s fault, within the limits of the actual costs incurred.
  4. c) the name and contact details, including the geographical address, of the entity responsible for providing insolvency protection;
  5. d) the name, address, telephone number, email address and, where available, fax number of the tour operator’s local representative, a contact point, or any other service that enables the traveller to communicate rapidly and effectively with the tour operator in order to request assistance or lodge complaints concerning any lack of conformity encountered during the execution of the package;
  6. e) the traveller’s obligation to report, without undue delay and taking into account the circumstances of the case, any lack of conformity detected during the performance of a tourist service under this contract, directly or through the retailer;
  7. f) in the case of minors unaccompanied by a parent or another authorised person, travelling under a package travel contract that includes accommodation, the information necessary to establish direct contact with the minor or with the person responsible for the minor at the place of stay;
  8. g) information regarding the existing complaint-handling procedures and the alternative dispute resolution (ADR) mechanisms available, pursuant to Legislative Decree No. 206 of 6 September 2005, and, where applicable, the ADR entity to which the professional is subject, as well as the online dispute resolution platform pursuant to Regulation (EU) No. 524/2013;
  9. h) information on the traveller’s right to transfer the contract to another traveller, along with the related conditions and costs.

8. PURCHASE PROPOSAL

  1. 1. The proposal for the purchase of a package travel contract must be drafted clearly and precisely using the appropriate contractual form, including—where applicable—through remote communication tools. The form must be completed in all its parts and signed by the traveller, including by electronic means. The traveller is also entitled to receive a paper copy where the package travel contract is concluded with the simultaneous physical presence of the parties.
  2. 2. Acceptance of the proposal for the purchase of the package travel contract is perfected—thereby concluding the contract—only when the tour operator sends the related confirmation, including through remote communication tools, to the traveller, also via the retailer, who shall ensure its delivery to the traveller. The traveller is entitled to receive precise information regarding the suitability of the trip or holiday in relation to the needs expressed in the purchase proposal, including suitability for persons with reduced mobility and any requests for special meals during transport or accommodation.
  3. 3. Pursuant to Article 36, paragraph 4 (Tourism Code), for contracts negotiated outside business premises, the traveller shall be provided with a copy or confirmation of the package travel contract on paper or, if the traveller agrees, on another durable medium. For contracts negotiated outside business premises under Article 45, paragraph 1, letter h) of Legislative Decree 206/2005 (Consumer Code), this refers to any contract between the professional and the consumer which is: 1) concluded with the physical and simultaneous presence of the professional and the consumer in a place other than the professional’s business premises; 2) for which an offer was made by the consumer in the same circumstances as in point 1; 3) concluded at the professional’s business premises or via any means of remote communication immediately after the consumer was personally and individually approached in a place other than the professional’s business premises, in the physical and simultaneous presence of both parties; or 4) concluded during a promotional trip organised by the professional with the purpose or effect of promoting and selling goods or services to the consumer.

9. OBLIGATIONS OF THE CLIENT AGENCY

The Client Agency is required to register and enter into a supply agreement for the Revolution booking system in order to purchase travel services/packages or to save travel ideas created or customised through the system. Access to the Website constitutes acceptance of all terms and conditions governing its use, with particular reference to the provisions set out below. The Client Agency acknowledges that the booking and purchase of products and tourist services carried out through the Website shall be governed by these General Conditions of Sale.
The Client Agency guarantees the truthfulness, accuracy and updating of the information provided by it in its own name and on behalf of all beneficiaries of the services booked on the Website, for whom it acts as representative, and to whom these General Conditions of Sale apply in full. It is the responsibility of the Client Agency to verify that the information entered is correct and, if necessary, to amend it before completing the booking. The first and last names of the participants must exactly match those shown on their identity documents required for travel.
EASY MARKET shall not be held liable in any way if the information provided by the Client Agency at the time of registration and/or order (name, postal address, email, telephone number, and any additional data required by the respective suppliers/providers to complete the online booking, etc.) is false or incorrect.
The Client Agency undertakes to preserve the confidentiality of its access credentials and not to disclose them in any way to third parties, and to prevent any unauthorised third party from accessing them. The Client Agency assumes responsibility for any damage and any economic consequences arising from the use of the Website with its own password, or from the use of the Client Agency’s passwords by third parties. EASY MARKET reserves the right to refuse, at any time, any booking request from a registered Client Agency if fraudulent use of the Website by the Client Agency or by third parties is detected.

10. TERMS OF USE

Access to the Platform is reserved exclusively for Client Travel Agencies that use the “Revolution” booking system. Without having signed the contract for the use of the aforementioned sales platform, it will therefore not be possible to book the packaged product sold through the platform dedicated to dynamic packages: https://easymarketspa.paquetedinamico.com).
These General Conditions govern the use of the Website by the Client Agency and the sale of the package products offered on the Revolution platform under the FLIGHT + HOTEL section available on the Website.
The General Conditions constitute a binding agreement between EASY MARKET and the Client Agency using the sales platform to book and purchase Travel Services/Packages). The Client Agency is also subject to the specific conditions applicable to individual Services where these cannot be reasonably calculated prior to the conclusion of the contract, but which the Client Agency may still be required to pay locally and which are not specified in EASY MARKET’s online catalogues because they cannot be prepaid. Such specific conditions form an integral and substantive part of the contract between EASY MARKET and the Client travel Agency.
The Client Agency is therefore required to read and expressly and fully accept the General Conditions, as well as any specific conditions applicable to individual Services, by ticking the relevant checkbox or clicking the constantly updated hyperlink provided for this purpose and made available before initiating any search. Without acceptance of the General Conditions and the specific conditions applicable to individual Services and travel packages—including package tours—it will not be technically possible to confirm the booking and purchase of such Services/travel packages.
The General Conditions may be amended at any time without prior notice; however, such changes shall not apply to orders submitted by the Client Agency prior to the modification. Therefore, the Client Agency must carefully read the current version of the General Conditions before making any booking or purchasing Services or travel packages on this Website by clicking on the hyperlink available before initiating any search.

11. WEBSITE REGISTRATION

To access and use the booking platform for package products, the Client Agency must register and request access credentials for the Revolution booking system, after signing the contract between the parties known as the EM CRS Agreement. Access to the packaged product platform will occur automatically once the Client Agency logs in to the Revolution Platform.
Following registration, execution of the Revolution Agreement, and activation of the platform access credentials (subject to verification of all requirements necessary for the use of the system as set out in the agreement), the Client Travel Agency will automatically be able to access the FLIGHT + HOTEL Platform.

12. REGULATORY SOURCES AND LIABILITY

The regulatory sources of reference are Articles 32–51 novies of the Tourism Code (Legislative Decree of 21 May 2018, No. 62, implementing Directive (EU) 2015/2302 on package travel and linked travel arrangements). All data will be processed pursuant to EU Regulation 2016/679, with the full privacy notice available during the registration phase on the Website.
The Client Agency declares and warrants that all data and personal information provided in the context of the registration process are up-to-date, complete, truthful and accurate. The Client Agency undertakes to promptly update on the Website any changes to its registration data.
The Client Agency shall be solely responsible for its Authentication Credentials, both with regard to their storage and to their use. Should the Client Agency become aware of any unauthorized use of the Authentication Credentials and/or any breach of password confidentiality, it must promptly inform EASY MARKET in writing.
All operations carried out through the Authentication Credentials are deemed to be performed by the Client Agency to which such Authentication Credentials refer.
EASY MARKET reserves, at its sole discretion and at any time, the right to:

  1. • terminate the contract with the Client Agency in the event of improper use of the Website or use contrary to the general terms of purchase;
  2. • refuse registration or delete existing Authentication Credentials, simultaneously deleting the relevant profile, without any obligation to communicate the reasons for such decisions or any right to compensation or indemnity arising therefrom;
  3. • exclude any liability of EASY MARKET for any damages, claims or losses, direct or indirect, suffered by the Client Agency due to the failure and/or malfunctioning of the Website or of the electronic equipment of the Users themselves or of third parties (including Internet Service Providers);
  4. • suspend or disconnect the Website, permanently or temporarily, without being held liable towards the Client Agency.
    EASY MARKET shall not be considered in default towards the Client Agency, nor liable for any damages, in the event it is unable to provide the electronic services connected to this Website or in the event the Client Agency is unable to access the Website due to malfunction of electronic communication systems for reasons beyond EASY MARKET’s control (such as, for example, unavailability of telephone lines or services provided by other network providers, malfunctioning of the Client Agency’s computers or other electronic devices, malfunctioning of software installed by the Client Agency, as well as actions by other users or persons accessing the network). EASY MARKET is not responsible for hyperlinks to websites operated by third parties other than EASY MARKET that may be contained on this Website; such links are provided for information purposes only, and the inclusion by EASY MARKET of hyperlinks to such websites does not imply any acceptance of the material published on those sites nor any relationship between EASY MARKET and their operators.

13. TERM AND NATURE OF THE OFFER

The offers of services/travel packages available on the Website are valid and may be purchased for as long as they are displayed on the Website, and may change in real time in terms of availability, price, and fare rules. In order to confirm the items in the shopping cart, during the passenger-name entry phase the system performs an additional check on all selected services and informs the Client Agency of any changes in availability and/or price compared to what was previously shown in the cart, before allowing the Client Agency to proceed with the purchase.
EASY MARKET seeks to provide, through the photos and illustrations supplied by the respective providers, a realistic representation of the services offered. However, the photos and illustrations included in the descriptions are purely illustrative in nature, are received and authorised solely by the providers of the respective services offered, and may not reflect the actual conditions of the facilities and services at the time of booking, as they are not constantly updated by the same providers. In any case, such photos and illustrations shall not be binding upon EASY MARKET except insofar as they indicate the category or level of the services.
Registered Client Agencies are referred to the photos and descriptions of the services published by the actual providers on their respective official websites. EASY MARKET does not guarantee the accuracy of the software, products, information, and services published on its Website, as they may contain typographical errors, inaccuracies, or system irregularities; it shall not be held liable in the event of inaccuracies in information relating to air, sea, or road transport, accommodation facilities, hotels, or any other information, product, or service present on the Website (such as, for example, video reproductions, photographs, etc.).

14. PRICES, TAXES AND CURRENCY

With regard to the travel package offered, the applicable price is the one indicated from time to time on the Website, provided that it corresponds to the outcome of a search performed by the Client Agency, unless there is an obvious and recognizable pricing error. The price of travel packages available for purchase on the Website varies depending on the season, the number of participants, and the selected services. The actual amount depends on the products effectively purchased and confirmed. Prices, availability, and fare rules applicable to services and travel packages may also change during the Client Agency’s purchase process. The transportation fares displayed on the VOLO + HOTEL online sales platform are subject to change. In addition, suppliers or carriers may adjust prices between the booking request and the actual payment.
Before completing the purchase, on the final screen titled “summary,” the total price of the services selected by the Client Agency is displayed.
The final offer—which constitutes the actual sales price—is therefore determined only after the Client Agency has completed the search and selection process, and more precisely only after entering the travellers’ names and receiving confirmation of all services, either directly online or via email. It is essential that the Client Agency verify the receipt of confirmations for all booked services; only in the event of discrepancies should the Client Agency contact EASY MARKET customer support through the dedicated link provided on the sales platform.
The descriptions of the Services/Travel Packages shown on the Website specify the services included in the price and any special conditions applicable thereto.
For services that include accommodation and transportation, prices are calculated based on the number of nights, not full days. Unless otherwise stated in the offer, prices do not include (non-exhaustive list):

  1. • entry/exit taxes required by certain countries, payable locally in cash upon arrival or departure;
  2. • tourist taxes and/or any Resort Fees or similar charges;
  3. • supplements applied locally by accommodation providers for late check-out or early check-in (always subject to availability and reconfirmation by the accommodation provider);
  4. • baggage supplements (when not included) or excess baggage fees for transportation or internal routes;
  5. • airport, port, or railway station parking;
  6. • visas and costs for administrative formalities required by individual countries for entry;
  7. • health formalities required for travel (preventive vaccinations, any pre-departure, in-trip, or pre-return testing based on entry/exit regulations of each country, medical care, etc.);
  8. • meals not included in the board basis of the selected accommodation, and meals consumed during layovers or while in transit;
  9. • beverages consumed during meals (if not already included in the selected board basis) and beverages consumed during layovers or while in transit;
  10. • special rates or additional services for children or infants, payable directly to the service provider;
  11. • optional visits and excursions, museum and site entrance fees (where not already included and explicitly stated in the programme);
  12. • paid activities (when not included in the package);
  13. • personal expenses;
  14. • mandatory gratuities in certain countries or for certain types of services;
  15. • customary gratuities for guides and drivers, particularly during tours or cruises;
  16. • any additional insurance offered directly to the Traveller by the service provider;
  17. • any supplements for vehicle drop-off at a location different from the pick-up point, where permitted;
  18. • optional equipment for rental services beyond the standard provision (GPS, child seats, snow chains, etc.);
  19. • any final cleaning fees (or similar) required at the end of stays in non-hotel accommodation facilities;
  20. • any additional bed requests beyond those included in the selected accommodation arrangement;
  21. • taxes imposed by local authorities, payable on site;
  22. • anything not specifically listed among the inclusions of the purchased services.

15. REVISION OF THE TRAVEL PACKAGE PRICE

Pursuant to Article 39 of the Tourism Code, the price of the travel package is set out in the contract, with reference to what is indicated on the Website. After the conclusion of the travel package contract, prices may be increased—up to a maximum of 8%—only if the contract expressly provides for this possibility and specifies that the Client Agency is entitled to a corresponding price reduction, as well as the method for calculating such price adjustments. When the price increase exceeds this percentage, the Client Agency may withdraw from the contract without incurring any penalty. The price may be adjusted, upward or downward, only as a result of changes in:

  1. • transportation costs, including fuel costs;
  2. • taxes and charges related to air transport, landing, disembarkation, or boarding fees at ports and airports;
  3. • exchange rates applied to the relevant package.

In any case, the price may not be increased in the 20 days prior to departure, and the adjustment may not exceed 8% of the original price. In the event of a price reduction, the tour operator is entitled to deduct administrative and actual handling costs from the refund due to the traveller. Upon the traveller’s request—submitted through the Client Travel Agency—the tour operator is required to provide evidence of such costs.

16. DURATION OF THE TRIP

The duration of the services/travel packages/travel ideas includes: the day of departure starting from the check-in/meeting time at the airport/port/train station, if provided; and the day of the return trip until the arrival time at the airport/port/train station.

  1. a) Prices are calculated based on the total number of travellers, the number of rooms, and the number of nights, not full days.
  2. b) “Night” refers to the period during which the room is available (as an indication, from 2:00 p.m. on the day of arrival to 10:00 a.m. on the day of departure, although different times may apply for certain accommodations/locations).
  3. c) The first and last days are generally dedicated to transportation when included.
  4. d) Therefore, if—due to schedules imposed by airlines (or carriers in general)—the first and last day and/or night are reduced because of a late-evening arrival or an early-morning departure, no refund will be granted. The same applies in the event that the stay is extended.
  5. e) No compensation will be granted in case of return on the day following the one scheduled in the contract.
  6. f) The Client Agency undertakes to notify EASY MARKET in writing at the time of booking, and therefore before the booking confirmation is sent, of any special personal requests, including the need for airport assistance for persons with reduced mobility, requests for special meals on board or at the destination, which may be subject to specific agreements regarding travel arrangements, provided that their fulfilment is possible and always subject to a specific agreement between the traveller and EASY MARKET.

17. ACCEPTANCE OF THE BOOKING

The Website allows bookings to be made starting from the third day following the date on which the Client Agency performs the search. It is not possible to conduct searches or make bookings with a departure date earlier than this timeframe or more than 11 months ahead.
To conclude the contract for the sale of a travel package, the Client Agency is required to:

  1. • start one or more searches using the search engine, completing all mandatory fields therein;
  2. • select its preferred options from the available results—each showing the corresponding price—and proceed with finalizing the booking by entering the participants’ names and any additional mandatory data, where required, without which navigation on the Website cannot proceed;
  3. • before confirming and proceeding with payment, take note of any price variations highlighted during the name-entry phase;
  4. • tick the relevant box confirming that it has read these general terms and conditions of contract (as well as the privacy policy, terms and conditions of use, and applicable cancellation penalties). Acceptance of the sales conditions constitutes a definitive booking, as it is an irrevocable offer from which withdrawal is not permitted, except as provided under Articles 15 and 19 and without prejudice to the applicable cancellation and modification rights;
  5. • proceed, if required, with payment by clicking the “pay” button or similar, for either the non-refundable deposit or the balance;
  6. • proceed within the required deadline with payment of the balance as indicated on the summary page;
  7. • Any errors detected after the order has been finalized—and any related correction costs—shall be entirely borne by the Client Agency, as EASY MARKET has no responsibility for manual data entry performed by the Client Agency during the booking process. EASY MARKET is exempt from any liability regarding the data voluntarily provided by the Client Agency, which undertakes to promptly inform EASY MARKET of any changes related to such data.

A booking made independently on the Website shall be deemed accepted and confirmed by EASY MARKET only when the Client Agency has received booking confirmation for the services/package, either directly online or by email. It is essential that the Client Agency verify the receipt of confirmation for all booked services; only if any discrepancies are identified, including partial confirmation of the selected services, must the Client Agency contact EASY MARKET Customer Service.

18. PAYMENT AND INVOICING

Payment for purchases made on the Website may be carried out by the Client Agency exclusively through the Website using a credit card belonging to the circuits indicated on the payment page at the end of the booking process. To proceed with payment, the Client Agency must enter its credit card details, which will be processed in compliance with Regulation (EU) No. 2016/679 and Legislative Decree 196/2003, as amended by Legislative Decree 101/2018. Such data will not be collected by EASY MARKET but will be handled directly by the banking institution, acting as an independent Data Controller. EASY MARKET only receives validation of the transaction from the banking institution.
At the end of the purchase, a booking confirmation email will be sent to the email address entered by the Agency in its Revolution user profile.

  1. b. For services purchased at a non-refundable rate, full payment is due immediately.
  2. c. For services purchased at a refundable rate, the balance is due within the deadline indicated by the system on the trip summary page.
  3. d. If the summary includes both non-refundable and refundable services, or travel packages—regardless of the number of services purchased (or included in the package)—the non-refundable deposit will be charged at the time of booking. The amount and the deadline for payment of the balance are always specified during the booking process on the summary page.
  4. e. The system sends alert emails to the same address used for the booking confirmation on the 3rd and 2nd day prior to the payment deadline, both for balances and for individual refundable services. The deadline refers to 12:00 noon (Italian time) on the indicated date if it is a business day, excluding Saturdays. If the date is a public holiday, the deadline is 12:00 noon (Italian time) on the previous business day. Failure to make payment by the deadline will automatically result in the cancellation of the originally booked services, with no right to a refund of any deposit paid.
  5. f. The Client Agency is solely responsible for payment.
  6. g. The Client Agency guarantees that it is fully authorized to use the credit card or any other payment method allowed on the Website and that the chosen method provides access to sufficient funds to cover all costs associated with each requested transaction.
  7. h. The authorization granted to EASY MARKET for charging the payment related to the booking is irrevocable. Therefore, the Client Agency is not permitted to oppose the payment except in cases of fraudulent use of the card by third parties—bearing in mind that use of the card within the system presupposes that the cardholder/travel agency enters its personal and confidential ID and Password to access the system, taking care to keep them secure and protected from third parties. The provisions of Articles 7 and 9 of the Revolution supply contract signed between Easy Market and the Client Travel Agency remain valid.
  8. i. The invoice is issued and electronically sent to the Client Agency no later than the 15th day of the month following payment. If a charge occurs without a corresponding booking confirmation, the system will indicate “booking not confirmed,” and the Client Agency will receive notification of the charge according to the selected payment method. The Client Agency is entitled to a full refund of the amount charged. The refund will be made within 5 days using the same payment method used by the Client Agency, which will be contacted by Customer Service for any possible alternatives.

19. EXCLUSION OF THE RIGHT OF WITHDRAWAL

Pursuant to Article 47, paragraph 1, letter g) of the Consumer Code, it is hereby communicated that, for contracts concluded at a distance, the right of withdrawal is excluded. Pursuant to Article 41, paragraph 7 of the Tourism Code, it is further communicated that, for contracts negotiated outside commercial premises involving offers with significantly reduced rates compared to competing offers, the right of withdrawal is excluded. Therefore, cancellation penalties indicated in the technical data sheet shall apply to the Client Agency that withdraws from a contract concluded at a distance or outside commercial premises at significantly reduced rates compared to competing offers.
Pursuant to Article 59 of the Consumer Code, Legislative Decree of 6 September 2005, No. 206, as amended by Legislative Decree of 21 February 2014, No. 21, the right of withdrawal is excluded with respect to contracts for the provision of accommodation, transport, car rental services, catering or services relating to leisure activities, where the contract provides for a specific date or season of performance. Therefore, the cancellation penalties provided for and indicated for each individual service shall apply to the Client Agency that withdraws from a contract concluded at a distance or negotiated outside commercial premises.

20. TRAVEL DOCUMENTS

Upon confirmation of the booking, the Client Agency receives a booking summary via email as well as, for information purposes, the transportation schedules if included in the booked offer. Such schedules may be subject to change. Any changes communicated to EASY MARKET will in turn be communicated to the Client Agency via email.
Once the balance has been successfully paid, the travel documents—issued in the form of electronic vouchers—may be downloaded directly by the Client Agency from its personal area on the Website for all participants included in the booking, or they will be sent via email to the address provided by the Client Agency as soon as they become available and in any case not before payment of the balance.
The Client Agency acknowledges that the travel documents are available and accessible in the personal area of the Website and must therefore ensure that they have checked their presence if required to present them to the provider/operator.
If the Client Agency makes an error in entering its own details (name, surname, email, phone number, date of birth, identity document, etc.) or those of the participants, EASY MARKET declines any responsibility for non-performance or incorrect performance of the trip resulting from failure to receive the travel documents or refusal of service by the providers.
Generally, when purchasing travel packages including air transport, scheduled and low-cost flights enable travellers to check in online directly on the websites of the respective carriers and to print the boarding pass in advance. For some carriers, this procedure is mandatory prior to departure. Therefore, it is the responsibility of the Client Agency to carefully read the information published regarding this requirement on the official websites of the respective carriers and to strictly comply with the instructions provided.
In any case, the Client Agency is invited to always review the transportation conditions of the selected carrier prior to departure.

21. ADMINISTRATIVE AND HEALTH FORMALITIES

It is the responsibility of the Travel Agency to verify that the travel documents of the package holders are necessary and compliant for undertaking the trip and to check for any changes in the applicable regulations (identity card, vaccination certificate, passport, green pass, and any other valid document required for all countries included in the itinerary, as well as entry, transit visas and any health certificates that may be required).
Travel is permitted only if travellers are in possession of an Identity Card or Passport in excellent condition and valid for the required season, depending on the destination country. As a general rule, a valid passport is required for destinations outside the European Union. Administrative and/or health requirements for travel may be consulted directly by the Client Agency—and its end Customer—at: www.viaggiaresicuri.it, without forgetting to check requirements of transit or stopover countries, and regulations relating to COVID-19, green passes, tests and quarantine measures. For Italian citizens, it is recommended to verify the validity and adequacy of their documents in advance by consulting the official website of the Italian State Police: www.poliziadistato.it/articolo/1087, the World Health Organization website: www.who.int, and the EASA site: www.easa.europa.eu/covid-19-travel-information.
EASY MARKET invites the Client Agency and/or its end Customer, if Italian, to verify with the competent authorities the validity of all documents, including those of minors—identity card or passport—along with any mandatory and/or recommended health treatments and visas.
The Client Agency must strictly comply with such formalities and ensure that the names indicated on all travel documents (bookings, tickets, vouchers) exactly match those shown on the corresponding identity documents, passports, visas, etc. EASY MARKET shall not be held liable in the event of non-compliance by the Client Agency and/or its end Customer with these obligations, particularly where boarding or disembarkation is refused or a penalty is imposed on the Client Agency or on participants for whom the registered Client Agency made the booking through the Website.
Under no circumstances may EASY MARKET be held responsible for costs or consequences resulting from non-compliance with customs or health regulations of the countries visited. When the service includes visa fees, it is understood that EASY MARKET cannot be held liable in cases where the visa is refused by the embassy of the destination country.
EASY MARKET reminds that the authorities of the destination country remain the sole entities entitled to authorize or deny entry into their territory. In case of visa refusal, it is the responsibility of the Client Agency and/or its end Customer to contact the embassy of the destination country directly to ascertain any appeals or procedures to follow.
Furthermore, in order to assess socio-political safety conditions, health conditions, and any other useful information relating to the destination countries—thus determining the objective usability of the services purchased or to be purchased—the Client Agency is required to obtain official general information from the Ministry of Foreign Affairs, as published on the institutional Farnesina website www.viaggiaresicuri.it, and from the World Health Organization website www.who.int.
If, at the time of booking, the selected destination is classified—according to institutional sources—as an area subject to an “advisory” for safety reasons, the Client Agency that subsequently exercises withdrawal on behalf of its end Customer may not invoke, for the purpose of exemption or reduction of the contractual withdrawal penalty, the disappearance of the contractual cause relating to the safety conditions of the destination country.
The Client Agency must also comply with the rules of normal prudence and diligence, as well as those specific to the destination country, with all information provided by the provider or tour operator, and with regulations, administrative provisions or legislative requirements relating to the travel package.

22. MINORS

As of 26 June 2012, all Italian minors may travel only with an individual travel document. The new regulations provide that Italian minors under 14 years of age who travel abroad without one of their parents or legal guardians must be in possession of an accompanying declaration indicating the name of the person, entity, or transportation carrier entrusted with the minor. This declaration must be signed by the person exercising parental authority and endorsed by the competent authorities responsible for issuing passports.
Minors may also benefit from the Visa-Exempt Travel Program (Visa Waiver Program) only if they hold an individual passport; being listed on a parent’s passport is neither sufficient nor valid.
If a minor under 14 travels with his or her parents (even just one parent), it is not necessary to attach an accompanying declaration to the minor’s passport, since the parents’ personal details (also in English and French) are provided on page 5 of the new 48-page passport booklet. For legal, religious, social, or other reasons, at the request of a parent or upon order of the Judicial Authority, such personal details may be omitted or removed.
For all companions other than the parents who have been duly authorised by them (via parental consent declaration), there is no requirement for their names to be listed on the document (e.g., grandparents). Therefore, whenever a minor under 14 must travel abroad with someone other than their parents, the parents must sign the accompanying declaration, which will remain filed with the police headquarters (Questura). The police will issue a standardised form that the companion must present at the border together with the minor’s valid passport.
Minors travelling with a parent must hold an authorisation to travel abroad if they do not share the same surname as the accompanying parent.
In all cases, it is the responsibility of the Client Agency and/or its end Customer to verify on the website www.viaggiaresicuri.it the documentation required for minors to enter the specific destination country, given the recent introduction of stricter procedures in some countries. Under no circumstances shall EASY MARKET be held liable for any irregularities relating to the documentation required for travel.

23. EU AND NON-EU CITIZENS

EU and non-EU citizens, whether adults or minors, must contact the competent authorities of their country of residence or of the destination countries before proceeding with the booking and purchase of travel services on the Website.
Obtaining up-to-date information in advance regarding the health, socio-political, and weather conditions of the countries to be visited, as well as the required travel documents, is an essential phase of responsible trip preparation, and constitutes one of the traveller’s obligations, being a necessary and appropriate activity to avoid unpleasant situations during the trip.
Passengers must hold a valid passport (with a minimum validity of 3 months and up to 6 months after the return date, depending on the destination country). It is advisable to always verify the validity of the personal documents required for travel abroad by contacting the competent authorities.
The obligation to verify the applicable regulations and the need for any entry visas—by contacting the Consulate of the country of citizenship and the destination country—applies even more strictly to non-Italian citizens or dual citizens, and to travellers who are not part of the European Union, as legal requirements may differ from Italian legislation or among their respective jurisdictions.

24. SPECIAL RULES FOR DESTINATIONS OR STOPOVERS

If the trip includes transit or a stay in the United States of America, please note that starting from 12 January 2009 it is mandatory to obtain an ESTA (Electronic System for Travel Authorization) in order to travel to the United States under the “Visa Waiver Program.” The authorization must be obtained before boarding the means of transport—air or sea—bound for the United States. Citizens of countries eligible for the Visa Waiver Program may apply for this authorization in advance via the Electronic System for Travel Authorization (ESTA) website.
To enter the United States under the Visa Waiver Program, travellers must hold one of the following documents:

  1. • an electronic passport issued on or after 26 October 2006
  2. • a machine-readable passport issued or renewed before 26 October 2005
  3. • a passport with a digital photo issued between 26 October 2005 and 26 October 2006.

In addition, travellers must:

  1. • travel exclusively for business and/or tourism
  2. • remain in the United States for no more than 90 days
  3. • hold a return ticket

Please note that from 27 January 2017 the possibility of using the Visa Waiver Program has been restricted for citizens with dual nationality, one of which belongs to the following countries: Iran, Iraq, Syria or Sudan; as well as for those who have travelled to the aforementioned countries since 1 March 2011, with exceptions for certain specific categories of travellers.
Starting 2 April 2025—with applications opening from 5 March 2025—Italian citizens, as well as all EU citizens, will be required to obtain an ETA (Electronic Travel Authorization) for short-stay trips (including transit) to the United Kingdom before departure. For non-EU citizens, the requirement applies from 8 January 2025, with applications opening from 27 November 2024. The ETA is not a visa but an electronic pre-travel authorization required for visa-exempt foreign nationals wishing to travel to the United Kingdom.

Packages to the Maldives: The purchased package may not include transfers to and from the airport and the booked accommodation. For almost all resorts in the Maldives, booking and using transfer services is essential to reach the final booked destination. Travellers who do not book the required transfers may lose all or part of the right to their stay at the booked property. It is therefore always the responsibility of the Client Travel Agency to verify the presence and/or availability of the transfer service, informing the travellers and requesting the transfer booking when not included. Easy Market declines any responsibility should the lack of transfer bookings in the Maldives result in full or partial inability to use the hotel services purchased through its sales channel.

25. HOTEL ACCOMMODATIONS

The official classification of hotel accommodation is provided solely on the basis of the explicit and formal indications issued by the competent authorities of the country in which the service is provided.
EASY MARKET reserves the right, in cases of force majeure, to replace the scheduled accommodation with another of the same type/category offering equivalent services. These are exceptional circumstances, of which the Client Agency will be informed as soon as EASY MARKET becomes aware, or which the Client Agency must in turn inform EASY MARKET about if notified directly by the provider or supplier of the service. The Client Agency is required to carefully select the rooms that explicitly specify the desired type and number of beds.
Important: In some countries, accommodation facilities do not have potable tap water. In such cases, the purchase of bottled drinking water is at the expense of the Client Agency.
EASY MARKET advises parents travelling with infants to bring all necessary food supplies with them before departure, as certain products may not be readily available in the destination country.

26. TRANSPORT SERVICE

In the event of complaints concerning transport-related disruptions, the Client Agency must refer exclusively to the conditions of the relevant carrier by consulting the carrier’s official website and following the complaint procedure in the designated section.
European regulations govern passengers’ rights and obligations in bus transport under Regulation (EU) No. 181/2011. The conditions of air transport are governed by the airlines’ own terms of sale.
Regulation (EC) No. 261/2004 establishes common rules on compensation and assistance to passengers in the event of denied boarding, flight cancellation, or long delay. For further information: www.enac.gov.it
The Montreal Convention and the Warsaw Convention apply with respect to delays in passenger transport and baggage damage, while the Italian Navigation Code applies to the aeronautical sector.
Regarding the purchase of airline tickets, EASY MARKET acts solely as an intermediary between the Client Agency and the airline. The conditions of air transport are determined by the airlines. Upon issuing the travel documents, EASY MARKET will inform passengers of the identity of the operating carrier, as required by Article 11 of Regulation (EC) 2111/2005. Schedule changes, route changes, stopovers, airport changes, delays, missed connections, and flight cancellations are typical inconveniences of air travel. In most cases, such disruptions are due to airspace congestion during certain seasons, compliance with air navigation rules, or the time required to provide airport services to aircraft, all for the purpose of ensuring passenger safety. Direct flights may be “non-stop” or may include one or more stopovers (according to some airlines, the flight number remaining the same is sufficient for it to be considered a single flight), and they may involve an aircraft change, without EASY MARKET necessarily being informed. The same applies to connecting flights, which may also involve an aircraft change.
When the Client Agency books a flight involving a stopover in a city and the connecting flight departs from another airport within the same city, the traveller must ensure that sufficient time is available to reach the second airport. The traveller is responsible for any such transfer costs. EASY MARKET will not refund these costs and will not be held responsible for missed connections. When a city has multiple airports, the airport name indicated is for guidance only and may be subject to change. EASY MARKET shall not be held responsible for any schedule changes, delays, cancellations, or other circumstances attributable to force majeure (including but not limited to strikes, weather events, war, earthquakes, epidemics) or attributable to the Client Agency (for example, late arrival at the airport, denied boarding due to non-compliance with administrative or health formalities, no-show at boarding).
Failure to present oneself for the outbound flight (charter/ITC, scheduled, or low-cost) automatically results in cancellation of the return flight or any connecting flights by the airline (“no-show rule”). This practice is solely attributable to the airline, which bears exclusive responsibility for it. EASY MARKET has no power in this respect and cannot therefore be held liable for the cancellation of the return flight or related connections. The Client Agency must contact the airline counters at the airport. The decision to maintain the reservation for the return flight or connecting flights is at the sole discretion of the airline.
Any interrupted journey does not entitle the traveller to any refund, including airport taxes. If the outbound or return feeder flight is cancelled or delayed, airlines reserve the right to provide alternative transport (bus, train, etc.).
If the Client Agency arranges its own feeder transport, whether outbound or return, it is advisable to purchase flexible or refundable tickets in order to avoid financial losses. The consequences of delays (e.g., missed check-in for a scheduled flight) when feeder flights are arranged independently by the Client Agency shall in no case be attributable to EASY MARKET.
Each airline has its own policy for cabin and checked baggage, as well as special baggage (such as sports equipment). The allowed checked baggage weight, when included, is indicated on the travel documents issued by EASY MARKET only if not already specified online during service selection by the registered Client Agency. The Client Agency must refer to the airline’s transport conditions and/or the boarding pass. In case of excess baggage, the Client Agency must pay a supplement directly to the airline at check-in, provided the airline accepts the excess weight and specifies the amount.
The airline is not responsible for baggage entrusted to it by passengers beyond the compensation limits set by applicable international regulations. In cases of damage, delayed delivery, theft, or loss of baggage, the Client Agency must file a damage report before leaving the airport. It is advisable to purchase insurance that covers the value of such items.
Infants under 2 years of age do not occupy a seat: their ticket price is generally 10% of the official fare, plus airport taxes.
Airlines may refuse boarding to pregnant passengers if, based on the stage of pregnancy, they deem there is a risk of premature delivery during the flight. For this reason, if pregnant, the Client Agency must verify the carrier’s transport conditions before making the booking.
EASY MARKET cannot be held responsible for boarding denied by the airline due to the passenger’s non-compliance with transport regulations.

EES INFORMATION NOTICE:

The Entry/Exit System (EES) is a new digital system for controlling the external borders of 29 European countries for third-country nationals travelling to Europe for short stays. It became operational on 12 October 2025. The 29 European countries using the EES will gradually introduce the system at their external borders over a six-month season. During this phase, travellers’ data may not be collected instantly at every border crossing point. Once the gradual rollout is complete, the EES will be fully operational at all external border checkpoints. The introduction of the EES aims to: modernise border management, enhance security, prevent fraud and combat irregular migration.

  1. • Which European countries use the EES? Austria, Belgium, Bulgaria, Czechia, Croatia, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, the Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden and Switzerland.
  2. • Who will be registered in the EES? The EES will register third-country nationals travelling to the European countries where the system is used for short stays, meaning up to 90 days within a 180-day season. Traveller data will be recorded in the EES regardless of whether they are required to obtain a visa or are visa-exempt. Certain categories of travellers are exempt from registration. The system will also record refusals of entry. The EES does not introduce any new requirements for individuals who enjoy free movement throughout Europe.
  3. • Which data does the EES collect? 1. Personal data extracted from the travel document, such as full name, date of birth, and nationality; 2. Date and place of each entry into and exit from the 29 European countries using the EES; 3. Biometric data, including facial image and/or fingerprints; 4. Information on any refusal of entry, where applicable.
  4. • Privacy: Travellers’ data will be collected and stored in full compliance with EU data protection rules and rights. 27. OTHER TYPES OF CONTRACTS

Any additional services purchasable on the Revolution platform outside of the Flight+Hotel platform are made available through third-party providers. Such services cannot be added to or combined with the services offered on the Flight+Hotel platform to form a travel package. The Client Agency may carry out searches through the engines labelled “car rental,” “transfers,” or “activities,” by completing the required fields and selecting—where available—the desired services; however, these services cannot form or integrate the package already concluded or to be concluded within the FLIGHT + HOTEL platform.

28. LIABILITY

EASY MARKET carefully selects its providers. EASY MARKET shall not, under any circumstances, be held liable for the non-performance or incorrect performance of any of the elements of the package or of a service attributable to the End Customer/Traveller, to force majeure, to unforeseeable circumstances, or to a third party not involved in the provision of the services included in the contract. EASY MARKET’s liability is in any case limited exclusively to the services purchased from EASY MARKET, excluding all services purchased from third parties. Compensation for damages, where due from EASY MARKET, is governed by the Italian Civil Code, the Tourism Code, and any applicable international conventions. For all services brokered by EASY MARKET, responsibility for their correct provision lies solely with the actual providers/suppliers.

29. LIABILITY AND ASSISTANCE OF THE TOUR OPERATOR IN THE PERFORMANCE OF PACKAGE SERVICES

  1. 1. The tour operator is responsible for the performance of the travel services included in the package travel contract, regardless of whether such services are to be provided directly by the tour operator, by its auxiliaries or agents acting in the exercise of their functions, by third parties whose services it uses, or by other travel service providers.
  2. 2. The tour operator is required to provide assistance whenever the traveller is in difficulty, even in the event of circumstances not attributable to the tour operator, in particular by providing appropriate information regarding health services, local authorities, and consular assistance, and by assisting the traveller in making remote communications and helping them to find alternative travel services. The tour operator may request payment of a reasonable cost for such assistance if the problem was caused intentionally by the traveller or through their negligence, limited to the actual expenses incurred.
  3. 3. The traveller is entitled to an appropriate price reduction for any season during which there was a lack of conformity, unless the tour operator proves that the lack of conformity is attributable to the traveller.
  4. 4. The traveller is entitled to receive from the tour operator, without undue delay, adequate compensation for any damage suffered as a result of a lack of conformity.
  5. 5. The traveller is not entitled to compensation if the tour operator demonstrates that the lack of conformity is attributable to the traveller, to a third party unconnected with the provision of the travel services included in the package travel contract and is unforeseeable or unavoidable, or is due to unavoidable and extraordinary circumstances.
  6. 6. In cases where the non-performance of the services included in the package is not of minor importance, having regard also to the traveller’s interest, the traveller may request from the tour operator or the retailer—according to the liability arising from the breach of their respective contractual obligations—in addition to, and independently of, the termination of the contract, compensation for loss of enjoyment of the holiday, relating to the wasted vacation time and the irrepeatability of the missed opportunity.
  7. 7. The tour operator or retailer who has granted compensation or a price reduction, or paid damages, or been compelled to comply with other obligations under these general contract conditions, is entitled to recourse against those who contributed to the occurrence of the circumstances or event from which the compensation, price reduction, damages, or other related obligations arose, as well as against those required to provide assistance and accommodation services under applicable law where the traveller is unable to return to the place of departure.
  8. 8. The tour operator or retailer who has compensated the traveller is subrogated, within the limits of the compensation paid, to all the traveller’s rights and actions against the responsible third parties; the traveller shall provide the tour operator or retailer with all documents, information, and evidence in their possession useful for the exercise of the right of subrogation.
  9. 9. It is specified that the technical organization relates exclusively to the services composing the FLIGHT + HOTEL package; therefore, any additional services purchased independently and/or not included in this FLIGHT + HOTEL sale shall be considered unrelated and thus not subject to the insurance coverage and protection under Legislative Decree 62/2018 (EU Directive 2015/2302) governing the sale of package travel contracts by Easy Market.

In the case of a package holiday, the tour operator is liable for damages suffered by the End Customer/Traveller due to the total or partial non-performance of the services contractually agreed, whether performed directly by the tour operator or by third-party service providers, unless it proves that the event resulted from the traveller’s actions (including autonomous initiatives undertaken during the performance of the travel services), or from circumstances unrelated to the performance of the contractual services, unforeseeable circumstances, force majeure, or circumstances that the tour operator—according to professional diligence—could not reasonably foresee or resolve.
In all cases where EASY MARKET acts solely as an intermediary of the package (including, by way of example but not limited to: the purchase through the flight + hotel channel of a single travel service lacking the element required by Art. 5.1(c)), it is not responsible for obligations arising from the organization of the trip, but is responsible exclusively for obligations arising from its role as intermediary and for the execution of the mandate conferred by the traveller, as specifically provided under Art. 50 of the Tourism Code, including the guarantee obligations under Art. 47 of the Tourism Code.

30. CANCELLATION AND MODIFICATION OF THE BOOKING

Any request to cancel or modify a booking confirmed through the Flight + Hotel platform must be made by the Client Agency directly on the Website, by retrieving its booking and clicking on “modify,” selecting the requested action from those available, including cancellation. Alternatively, such requests may be made by contacting EASY MARKET Customer Service, which is operational during the working days and hours indicated on its Website. All requests will be handled during EASY MARKET’s working days and hours; handling the request does not imply the automatic approval of the modification by the provider, nor its approval without additional charges.
Requests to change the destination/accommodation/means of transport, etc., do not constitute a modification request, but rather a full cancellation of the original booking confirmed by EASY MARKET in favour of a new one. In such cases, the Client Agency must follow the cancellation procedure.
Penalties will always apply if the Client Agency has selected and subsequently purchased services with a non-refundable/non-modifiable rate.
The cancellation of the trip by only some of the participants compared to the total number of booked travellers may result in the full cost of the trip being applied.
For modification requests, EASY MARKET will check availability with the service provider(s) and send the Client Agency a quote as soon as the necessary information is available. Furthermore, a modification request cannot be considered equal to its acceptance.
All modification/cancellation requests submitted by the Client Agency must be explicitly confirmed by EASY MARKET. Any alternative proposal/re-protection offer made by EASY MARKET to the Agency is considered binding upon request and always subject to reconfirmation by the providers of the services included in the package. Therefore, in the absence of confirmation within 7 (seven) days from the submission of the modification request, or before departure or service start date (whichever occurs first), the Client Agency must consider the request as not accepted, and the original booking shall remain unchanged.
In the event of a cancellation request, the amount of penalties—updated in real time and calculated according to the cancellation rules of each purchased service or as provided by the tour operator—is indicated in the booking summary, available at any time on the Website by the registered Client Agency.
In case of cancellation, administrative fees and insurance premiums are never refundable.
Likewise, external costs not included in the service and already incurred by the Traveller and/or the Client Agency at the effective cancellation or modification date (including, but not limited to: visa issuance, travel expenses, vaccination fees, ancillary services purchased directly from providers by the Client Agency or the travellers after the booking made on the Website) are not refundable by EASY MARKET under any circumstances.
If the Traveller is directly informed by the service providers of the services purchased on the Website—or by their respective suppliers—or by EASY MARKET regarding the unavailability or modification of one or more services, they may contact and will be assisted by EASY MARKET Customer Service during working days and hours, or by the Emergency Service during non-working days or hours (through a customer support system operated by the Client Agency via the channels provided on the platform).
Cancellation of the booking by the Client Agency—regardless of the reason—does not exempt it in any way from the obligation to pay the applicable penalties. Any interrupted stay or any service originally confirmed but not used by the Client Agency, particularly in cases of no-show at the airport, port, station, or hotel, or late arrival at the meeting point for any service, will not entitle the Client Agency to any refund.

31. AMENDMENT OF OTHER TERMS OF THE PACKAGE TRAVEL CONTRACT AND WITHDRAWAL

In the event of unavoidable and extraordinary circumstances occurring at the place of destination or in its immediate vicinity which have a substantial impact on the performance of the package or on the transport of passengers to the destination (such as earthquakes, natural disasters, acts of terrorism), the Traveller has the right to withdraw from the contract before the start of the package, without paying any withdrawal fees, and to obtain a full refund of all payments made for the package. The Traveller is not entitled to additional compensation. Cancellations that do not arise from the above circumstances—even if the Traveller is unable to enjoy the holiday—do not entitle the Traveller to a cost-free withdrawal under the law.
If the Client Agency wishes to withdraw from the package travel contract at any time before departure, outside of the cases provided above, it must reimburse the tour operator for the expenses incurred, provided they are appropriate and justifiable. The tour operator shall provide an explanation of such costs to the Traveller upon request. The withdrawal fee corresponds to the package price minus any cost savings and revenue generated from reallocation of the travel services. The package travel contract may set out standard withdrawal fees, which must be reasonable and calculated based on the time of withdrawal.
The tour operator may withdraw from the package travel contract and offer the Traveller—via communication to the Client Agency—a full refund of all payments made for the package, without being required to pay additional compensation, if:

  1. a) the number of participants registered for the package is below the minimum required under the contract, and the tour operator notifies the Traveller within the deadline set in the contract and, in any case, no later than:
    • 20 days before the start of the package for trips lasting more than six days;
    • 7 days before the start of the package for trips lasting between two and six days;
    • 48 hours before the start of the package for trips lasting less than two days;
  2. b) the tour operator is unable to perform the contract due to unavoidable and extraordinary circumstances and notifies the Client Agency of the withdrawal without undue delay prior to the start of the package.

The tour operator shall make any refunds due—after deducting appropriate expenses—without undue delay and in any case within fourteen days from the withdrawal. In such cases, all linked contracts concluded with third parties shall be terminated accordingly.

SINGLE SERVICES: For individual travel services purchased outside the Flight + Hotel platform, the Client Agency acknowledges that the rates applied by individual providers—including transport, car rentals and accommodation—are subject to specific conditions. Tickets and reservations issued are normally non-modifiable and non-refundable and do not follow the cancellation and modification rules applicable to package products.

32. AMENDMENT OR CANCELLATION OF THE PACKAGE BEFORE DEPARTURE

The tour operator of the package travel reserves the right to unilaterally modify contract conditions—other than the price—in accordance with Article 39 of the Tourism Code, provided such modifications are of minor importance. The tour operator shall communicate the modification to the Client Agency clearly and accurately on a durable medium, for example by e-mail. If, before the start of the package, the tour operator is compelled to significantly alter one or more of the main characteristics of the travel services as referred to in Article 34, paragraph 1, letter a) of the Tourism Code, or is unable to fulfil the specific requests referred to in Article 36, paragraph 5, letter a) of the Tourism Code, or proposes to increase the package price by more than 8% in accordance with Article 39, paragraph 3, the traveller, within a reasonable season specified by the tour operator, may:

  1. a) accept the proposed modification by the tour operator;
  2. b) withdraw from the contract without paying any penalty. In case of withdrawal, the tour operator may offer the traveller a substitute package of equivalent or superior quality.

The tour operator shall inform the traveller, without undue delay, clearly and precisely on a durable medium, of:

  1. a) the proposed modifications and their impact on the package price;
  2. b) the consequences of the traveller’s failure to respond, and any substitute package offered and its price.

The traveller must notify the tour operator of their decision within two working days from the moment they receive the modification notice. If the amendments to the package travel contract or to the substitute package result in a package of lower quality or lower cost, the traveller is entitled to an appropriate price reduction. Only in cases of withdrawal from the package travel contract due to a price increase exceeding 8% or due to essential modifications as indicated above—and provided that the traveller does not accept a substitute package—shall the tour operator refund, without undue delay and in any case within 14 days, all payments made by or on behalf of the traveller, and the traveller shall be entitled to compensation for non-performance of the contract, except in the following situations:

  1. a) no compensation shall be due if the cancellation of the package is caused by failure to reach the minimum number of participants, where required;
  2. b) no compensation shall be due if the tour operator proves that the lack of conformity is due to force majeure or unforeseeable circumstances;
  3. c) no compensation shall be due if the tour operator proves that the lack of conformity is attributable to the traveller or to a third-party unconnected with the provision of the travel services included in the package travel contract and is unforeseeable or unavoidable.

33. COMPENSATION

Compensation for damages arising from the non-performance or improper performance of the services included in the package travel contract, as well as the limitation periods, is governed by Articles 43–46 of the Tourism Code, which are fully referenced in Article 29 of these general terms of use. The tour operator is subject to the limitations provided for in the international conventions in force that bind Italy or the European Union, relating to the amount of compensation or to the conditions under which compensation is due by a provider performing a travel service included in a package. The travel package contract may provide for a limitation on the compensation owed by the tour operator—except in cases of personal injury or damages caused intentionally or through negligence—provided that such limitation is not lower than three times the total price of the package. Any right to compensation or price reduction under this Chapter does not prejudice travellers’ rights under Regulation (EC) No. 261/2004, Regulation (EC) No. 1371/2007, Regulation (EC) No. 392/2009, Regulation (EU) No. 1177/2010 and Regulation (EU) No. 181/2011 of the European Parliament and of the Council, as well as under international conventions. However, the compensation or price reduction granted under this Chapter and that granted under said regulations and international conventions shall be offset against each other.

34. STATUTORY TIME LIMITS FOR EXERCISING THE TRAVELLER’S RIGHTS

  1. 1. The right to a price reduction or to compensation for damages is subject to a limitation season of two years, starting from the date on which the traveller returns to the place of departure, without prejudice to paragraph 2 below.
  2. 2. The right to compensation for personal injury is subject to a limitation season of three years from the date of the traveller’s return to the place of departure, or for the longer season provided for compensation of personal injury under the laws governing the services included in the package.
  3. 3. For the purpose of complying with limitation seasons or deadlines, the date on which the retailer receives messages, requests, or complaints referred to in paragraph 1 shall be considered the date of receipt also for the Tour operator.
  4. 4. The suspension of the limitation season shall apply in the event of a suspension of procedural time limits before the ordinary or administrative courts pursuant to Law No. 742/1969 and subsequent amendments, where applicable.

35. INSOLVENCY OR BANKRUPTCY PROTECTION OF THE TOUR OPERATOR OR RETAILER

  1. 1. The package travel contracts and linked travel arrangements referred to in Article 5 of these general contract conditions are covered by insurance policies, bank guarantees, or by funds, consortia, or other associative mechanisms which, in the event of insolvency or bankruptcy of the tour operator or retailer—whether for trips abroad or within a single country, including Italy—ensure, without delay upon request of the traveller, reimbursement of all amounts paid for the purchase of the package and the immediate repatriation of the traveller if the package includes transport. Where necessary, these guarantees also cover board and lodging before repatriation.
  2. 2. Travellers benefit from protection in the event of insolvency or bankruptcy of the tour operator or retailer regardless of their place of residence, the place of departure, the place of sale of the package, or the EU Member State in which the entity providing insolvency protection is established.
  3. 3. In the cases described in paragraph 2 above, as an alternative to reimbursement or immediate repatriation, the traveller may be offered the continuation of the package, under the conditions set out in Articles 28, 29, 31, and 32 of these general contract terms.
  4. 4. Tour operators and retailers not established in an EU Member State who sell or offer for sale packages in Italy or in another EU Member State—or who, by any means, direct their activities towards Italy or another EU Member State—are required to provide travellers with a guarantee equivalent to that provided for in this Article.

36. LIABILITY OF THE RETAILER

  1. 1. The retailer is responsible for performing the mandate entrusted to it by the traveller under the travel brokerage contract, regardless of whether the service is performed by the retailer itself, by its auxiliaries or agents acting in the exercise of their functions, or by third parties whose services it uses. Compliance with the obligations undertaken must be assessed with regard to the level of diligence required for the performance of the corresponding professional activity.
  2. 2. The professional is liable for errors caused by technical defects in the booking system that are attributable to it and, where it has agreed to arrange the booking of a package or travel services that constitute linked travel arrangements, for errors committed during the booking process.
  3. 3. The professional is not liable for booking errors attributable to the traveller or resulting from unavoidable and extraordinary circumstances.
  4. 4. The retailer is considered a tour operator in relation to a package travel contract if it fails to provide the traveller with the relevant standard information forms IIA and IIIA referred to in Article 6, paragraph 1, of these general contract conditions, or if it fails to provide the traveller with information relating to the trade name, geographical address, telephone contact and email address of the tour operator, or if it fails to inform the traveller that it is acting in the capacity of retailer.
  5. 5. If the tour operator is established outside the European Economic Area, the retailer established in an EU Member State is subject to the obligations applicable to tour operators under these general contract conditions, unless it provides evidence that the tour operator complies with these requirements.
  6. 6. Pursuant to Article 50 of the Tourism Code, the retailer is responsible for performing the mandate entrusted to it by the traveller under the travel brokerage contract, and compliance with the obligations undertaken must be assessed with regard to the level of diligence required for the corresponding professional activity. Therefore, the retailer is obligated to promptly inform the tour operator of any communication received from service providers—including air carriers, and in particular low-cost carriers—before and during the execution of the travel contract, with regard to schedule changes (flight times, departure and arrival airports, and any other relevant notices), so that the tour operator may immediately inform the traveller. If the retailer fails to notify, or fails to promptly notify, the tour operator, the retailer shall be liable for such omission towards the traveller and agrees to indemnify and hold the tour operator harmless from any claims for damages made by the traveller against the tour operator due solely to the retailer’s failure to fulfil its obligations.

37. NON-DEROGABILITY OF THE TRAVELLER’S RIGHTS

  1. 1. A declaration by a package tour operator or a professional facilitating a linked travel arrangement stating that they act solely as a provider of a travel service, as an intermediary, or in any other capacity, or that a package or linked travel arrangement does not constitute such, does not exempt tour operators or professionals from the obligations imposed on them under these general contract conditions.
  2. 2. Travellers cannot waive the rights granted to them under the provisions of these general contract conditions.
  3. 3. Without prejudice to any specific legal provisions referred to in Article 2 of these general contract conditions, any contractual clause or declaration made by the traveller that excludes or limits, directly or indirectly, the rights arising from these general contract conditions—or whose purpose is to circumvent their application—shall not be binding on the traveller.

38. TRAVELLER’S OBLIGATIONS

The traveller must be in possession of an individual passport or other valid document required for all the countries included in the itinerary, as well as any necessary entry or transit visas and health certificates. In all cases, before departure, the traveller must verify the validity and adequacy of such documents with the competent authorities (for Italian citizens, local police headquarters Questure, or the Ministry of Foreign Affairs via www.viaggiaresicuri.it or the Operative Call Centre at 06.491115) and comply accordingly before travelling.
In the absence of such verification, neither the retailer nor the tour operator may be held responsible for the traveller’s failure to depart. The traveller must promptly inform the retailer—and the retailer is required to verify under Article 34, first paragraph, of the Tourism Code, as the package was sold through them—and the tour operator of the traveller’s nationality. At the time of departure, the traveller must ensure definitively that they are in possession of all required vaccination certificates, an individual passport, and any other valid document needed for all countries included in the itinerary, as well as any necessary entry or transit visas and health certificates. As the principal in the travel contract, the traveller is always required to inform the intermediary and the tour operator of any personal needs or special conditions (disabilities, pregnancy, allergies, food intolerances, special dietary regimes, etc.), and must explicitly specify in writing any related request for personalised services.

39. ASSISTANCE

EASY MARKET provides assistance through its Customer Service, in Italian and English, to Client Travel Agencies registered on the Revolution platform, during the working days and hours specified on the sales platform. The Client Agency is provided with an emergency telephone number or the contact details of a designated point of contact through which the provider/supplier can be reached during non-working days and hours for EASY MARKET, in the event of issues strictly related to services or travel packages confirmed by EASY MARKET.
It is strongly recommended to include a passenger telephone contact at the time of booking. Should any irregularities occur, the provider will thus be able to contact the final customer to inform them and provide assistance, even where any changes/cancellations have not been recorded within the booking. EASY MARKET shall not be held liable for missing and/or incorrect communications, nor for any resulting consequences, if passenger contact details are not included in the booking.

40. COMPLAINTS

Any complaint concerning the non-performance or improper performance of the contract shall be notified by the Client Agency to the supplier, the package tour operator and, where applicable, to the local representative, in compliance with the duties of fairness and good faith pursuant to Articles 1175 and 1375 of the Italian Civil Code. Such notification shall be made without undue delay, so as to enable the tour operator and/or the service provider to promptly remedy the non-conformity, unless such remedy is impossible or entails disproportionate costs having regard to the nature of the non-conformity and the value of the travel services concerned. Pursuant to Article 7.1(f) of the General Terms and Conditions, travellers are hereby informed that, should they remain dissatisfied with the outcome of the complaint-handling process carried out by Easy Market, they may submit their complaint through the ODR (Online Dispute Resolution) Platform, a no-cost mechanism established by the European Union to facilitate the out-of-court resolution of disputes involving consumers within the EU, Norway, Iceland and Liechtenstein. The ODR Platform is available in all EU languages, provides guided procedures with built-in deadlines for complaint resolution, and can be accessed at: https://ec.europa.eu/consumers/odr.
Contracts concerning only transport services, only accommodation services, or any other travel service sold separately shall not constitute a package travel contract or an organised travel arrangement. Such contracts fall outside the scope of the protections afforded under the Italian Tourism Code, and the contractual terms of the individual supplier or actual service provider shall exclusively apply.
With respect to disruptions relating to air transport – including loss, delay, or damage of baggage during carriage by air—the Client Agency and/or the traveller shall first address the matter to the air carrier, reporting the issue prior to leaving the airport premises. A formal claim shall subsequently be submitted, accompanied by the originals of the following documents: the travel document; the baggage irregularity report; the baggage check-in receipt. Where an insurance policy covering risks such as baggage loss or damage, or flight delays has been purchased, the Client Agency and/or the traveller shall submit a claim to the insurance company within the time limits prescribed by the policy. Claims shall be accepted only if accompanied by all supporting documents required under the relevant insurance contract.

41. INSURANCE

All products selected and purchased through the package sales platform known as VOLO + HOTEL include an insurance policy underwritten with MAPFRE ASISTENCIA Compañía Internacional de Seguros y Reaseguros S.A., coverage: MADWY, Policy No. R99POV1000252, Policyholder: EASY MARKET S.p.A. In the event that a travel insurance policy is purchased through the Website, the relevant insurance contract shall be concluded directly with the Insurance Company, whose terms and conditions shall apply to such insurance. EASY MARKET acts solely as an intermediary and assumes no liability in connection with the insurance coverage, its performance, or the interpretation of its terms.

42. GOVERNING LAW

These General Terms and Conditions, as well as the relationship between the Client Agency and EASY MARKET, shall be governed by and construed in accordance with Italian law, including the provisions of the Italian Tourism Code and Legislative Decree No. 206 of 6 September 2005 (the Consumer Code) insofar as applicable to distance contracts. These Terms and Conditions are drafted in both Italian and English. Contracts concluded through the EASY MARKET Website shall be deemed to be executed in Italy and governed by Italian law, without prejudice to any additional rights afforded to Consumers under the law of their country of residence. For any dispute arising out of or in connection with these terms and conditions, the Court of Rimini shall have exclusive jurisdiction, without prejudice to the right of Consumers to bring proceedings before, or to be sued only in, the courts of their State of residence. General terms of the contract

1) SUBJECT:

The general terms presented here define the registration and use of the service Revolution by Easy Market CRS, in further text named Service (or Revolution), which is regulated, besides by these General terms, by the Request to have access for the use of the Service. Users are asked to read legal and technology conditions and information at the website www.easymarket.travel and to ask to receive them directly from Easy Market S.p.A. at any moment. The service provided by Easy Market S.p.A. allows travel agencies, in further text named User (licensed travel agency) to:

  • Use the service and book various offer present, book flights (with existing fees) and low cost flights, with a possibility to independently decide about agency fee;
  • Use technical support which Easy Market provides at phone number 0541 161 0200 (commercial department) or in a written form by mail to sales@easymarket.travel

Easy Market holds the right to expand and change the gamma of the functions offered inside the service if, in the light of the new features’ specifications, it is necessary to update General Terms or to adjust them. All modifications will be communicated by Easy Market. Easy Market holds the right to change or delete the functions of the services. The user will pay the costs of the connection via phone.

2) DURATION OF THE CONTRACT:

The use of the system is free. Registration can be done through the procedure at the company’s website www.revolution.travel and later acceptance of the general terms and conditions with respect to the Law 675/96; acceptance of the Terms and signing of a yearly contract for the use of Revolution. Contract for the use of Revolution is accepted once it is signed and stamped by the agency, followed by the acceptance of the general Terms and conditions (signature and stamp) and the License for the activity of travel agencies and sent to the e-mail address sales@revolution.travel

3) ACTIVATION AND SUSPENSION:

The contract is finalized once Easy Market S.p.A provides the Service based on the acceptance of the terms and conditions by the User. In the case of the technical or normative change of the conditions for the delivery of the Service, Easy Market S.p.A will have the right to suspend the Service with the cancellation period of 15 days, notifying the agency via e-mail to the address mentioned in the signed contract.

4) CONFIDENTIALITY:

Access to the Service is possible by the use of the identification code (User ID), provided by Easy Market S.p.A, and keyword (Password), chosen by the User at the moment of the registration; these credentials will be the only one to be used for all the functions of the Service. Client will protect the password with maximum attention, keeping the confidentiality of the both User ID and password throughout the whole contract duration. The client is asked to keep, with the same confidentiality, the privacy of the other identification elements for any additional service activated. The client is solely responsible for any damage caused by the use of the User ID and password, as well as for the activation of the multiple identities by the third party. The client is responsible to immediately communicate to Easy Market S.p.A. any steal, use or loss of the User ID or password, or any eventual activation of the multiple identities.

5) GUARANTY:

Client guarantees that any material or a message inserted into the public zones of Revolution, and which might be traced back to her due to the contract signed, is solely her own property and/or is on her disposal, and asks from the client to release from any responsibility and protect Easy Market S.p.A from any eventual damage coming from it. Client guarantees that that material does not violate or break any author’s rights, copyrights, brands, patents or any other legal, contractual or custom rights. Client acknowledges that it is forbidden to use or allow the use of the Service against moral and public order or with purpose to interrupt public or private order and peace, to insult, directly or indirectly damages anyone and disturbs the privacy of the private messages. It is forbidden to sell that service to the third parties; in any case client’s information must not contain any pornographic, obscene, blasphemous or shameful content. It is strictly forbidden to use the service which directly or indirectly breaks the laws of the State of Italy or any other country. Accordingly to the following art. 10 and the right of Easy Market S.p.A. to ask for the automatic end of the contract, the use of the Service shall be terminated any time when there is an evidence about the violation of the client’s obligations.

6) THE USE OF THE SERVICE REVOLUTION:

Client is allowed to use the Service Revolution completely free through the registration and according to the specification for each function. Particularly, the function “Access” can be used by the individual Users/Clients/Agencies, there cannot be established multiple connections from different branches of the same agency at the same time but there can be established multiple access from different terminals of the same branch (office). In any case, it is strictly forbidden to pass the contract for the use to the third party, free or with charge, temporary or definitely, without written permission of Easy Market S.p.A.

7) USERS OBLIGATIONS:

User/Travel agency is obliged to use the Service at least during the probation period in order to test all the system’s functions. Easy Market S.p.A. will immediately interrupt the Service in any moment by deactivation of User ID for the access.

8) DOCUMENTATION AND IDENTIFICATION OF THE CLIENT:

When it comes to the functions which ask internet connection, client acknowledges the existence of the electronic register of the Service, filled and kept by Easy Market S.p.A. Log content is completely protected and kept private and is accessible only through the request of legal authorities. In order to confirm with certainty the root of the connection, client accepts the identification which Easy Market S.p.A. makes in the moment of the access into the system by the use of the access code containing User ID and password.

9) RESOLUTION CLAUSE:

In any case when client fails to respect the obligations from the articles 4,5,6 and 7 of this Contract, Easy Market S.p.A will be enabled to terminate this contract and ask for the remuneration for the damage caused.

10) COMMUNICATION:

All notifications regarding the contract are sent to the e-mail address communicated by the client.

Easy Market spa acts as an intermediary in the sale of tourism products to Travel Agencies (the data subject).
Pursuant to article 13 of GDPR (Regulation EUE 2016/679), we shall provide you (the data subject) with the information on the processed personal data and who is going to process them, in order to ensure a fair and transparent processing.

2) SCOPE, LEGAL FRAMEWORK, PURPOSE OF THE PROCESSING AND DURATION OF DATA RETENTION
Your personal data are collected for the following purposes:
a) Fulfilment of laws, regulation, secondary legislation:

  • The legal basis for this processing is the duty for the Data Controller to fulfil a legal obligation;
  • The personal data will be retained during the duration of the contract and for 10 years after the termination of the contractual relationship. In the event of litigation, the data will be retained over the duration of the litigation and until the judgment becomes final.
  • The collection of personal data is mandatory by law; in the event of refusal, the contract shall not be performed.

b) Management of the tourism service:

  • The legal basis for this processing is to execute the contract to which the data is a party of as well as the pre-contractual fulfilments requested by the data subject;
  • The personal data will be retained during the duration of the contract and for 5 years after the termination of the contractual relationship;
  • The collection of personal data is due in consideration of the binding contract in place between the parties and, in the event of refusal, the contract shall not be performed.

c) Sending marketing material and promotions in relation to the Data Controller’s activity (newsletter, offers…) similar to services already provided, market researches, even if anonymized (Travel Agency preferences and satisfaction surveys…):

  • The legal basis for this processing is the right of the Data Controller to pursue its legitimate interest;
  • The personal data will be retained as long as the data subject submits the request to unsubscribe from the promotional service/newsletter.

3) THE PROCESSING OF PERSONAL DATA
We consider as processing of personal data any operation or group of operation, put in place with or without automatic processes and applied to personal data or groups of personal data, such as collection, recording, organization, registration, retention, selection or amendment, extraction, consultation, use and communication by transmission, publication or in any other way, disclaimer, comparison, interconnection, limitation, cancellation and destruction.
Personal Data defined as special category of data under article 9 GDPR, can also be collected. These data are those revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, data concerning health or data concerning a person’s sex life or sexual orientation. The Data Controller shall have the right to process such data, prior express written consent.

We will be processing the following personal data:
-Data to get access to the secure area
By registering to access to the secure area, the Data Controller processes the following personal data:

  • Travel agency details [name, family name (point of contact of the Travel agency), e-mail, fiscal code, telephone number, Mobile phone, registered office address]
  • Final customers details [name, family name, e-mail, date of birth, place of birth, nationality, fiscal code, sex, telephone number, mobile phone number, address, ID card details, disabilities, health information, religion]

-Data to get access to the newsletter
Personal data processed to get access to the newsletter are name, family name, e-mail.
-Browsing data
IT systems and software procedures used to run this website, automatically collect personal data whose transfer is implied in the Internet communication protocols.
This category comprehends IP addresses, domain names, URI/URL (Uniform Resource Identifier/Locator) websites, the methods used to submit the request to the server, the size of the file obtained as a feedback and other parameters related to the operative system and the user IT environment.
These data, which are necessary to use the web services, are also processed to:

  • obtain statistics on the use of the services (most visited pages, number of visitors for time slot or daily, geographical area, etc.);
  • check the correct functioning of the offered services.
    Browsing data will be retained for no longer than 365 days and are immediately deleted after their aggregation (except if needed by the judicial authority to ascertain criminal offences).

-Data communicated by the user
Whenever a user voluntarily and explicitly sends correspondence to the Data Controller’s addresses, the contact details and the personal data included in the correspondence are acquired as necessary to get in touch with and reply to the sender.
The user has the right to register to the website to access the secure area and use the services offered by the Data Controller.

4) PERSONAL DATA RECIPIENTS
for the abovementioned purposes, your personal data can be shared with:

  • those typically acting as data processors meaning companies, individuals or professionals that provide the Data Controller with accounting, administrative, legal, tax and debt collection services;
  • those with whom it is necessary to liaise in relation to the provision of the services;
  • individuals, entities or authorities to whom it is mandatory to share the personal data communicate, in compliance with applicable laws or orders;
  • personnel expressly authorized by the Data Controller, that abides by confidentiality agreements or has a confidentiality duty or receives operative instructions, necessary to put in place activities strictly connected with the provision of the services;

The data processors’ list is available by sending a written request to the Data Controller.

5) TRANSFER OF PERSONAL DATA
Some of your personal data are shared with recipients that may be located outside the European Union. The Data Controller shall ensure that the personal data are processed by such recipients in compliance with the GDPR. 6) AUTOMATED INDIVIDUAL DECISION-MAKING, INCLUDING PROFILING
The Data Controller, to execute or perform the contract, shall implement an automated decision-making process on the processing of personal data, including profiling as set forth by article 22 of the GDPR, with the purpose to tailor the price list based on the origin of the Travel Agency.

7) DATA SUBJECT RIGHTS
The data subjects have the right to obtain from the Data Controller, in the events provided, access to the personal data, their rectification or deletion of personal data or restriction of processing or to object to such processing (articles 15 and following of the GDPR). 8) RIGHT TO FILE A CLAIM
