Terms and conditions of the booking

In order to use the services provided by Easy Market a client needs to accept Terms and Conditions of use and Privacy Policy which we present in the following text.

Content and use of the Easy Market website

Booking and purchase of the services presented on the Easy Market website is regulated under the contractual conditions created by the providers of those products and services. Each user of the platform needs to read and accept the presented Terms and Conditions in order to continue with booking and/or payment.

Collection, use and any other operation with the information gained during the process of purchase will be done accordingly to Privacy Policy which is part of general Terms and Conditions. Agency is obliged to use Easy Market, its functions and services provided in licit purposes and respect general Terms and Conditions and conditions referring to the delivery of those services.

External links and Easy Market websites

Easy Market website is connected with our partners’ and third parties’ websites. Publication of the external hyperlinks is done with a solely informational purpose to navigate user’s activity and does not implicate any approval or confirmation of the former or of the content added by Easy Market.
Easy Market does not have control over content, information, services and/or products published by the external hyperlinks and does not take any responsibility for the trustworthiness, accuracy and change of the information published on those websites. If not specified, publishing of hyperlinks or any other internet site does not imply existence of any business association and/or cooperation between Easy Market and entities behind those sites.

Personal information which users provide to Easy Market are registered on the protected electronic devices located on our servers and shall be used according to Law decree 196/2003 (Private information protection law) with respect to the principles of correctness, justice and transparency.

  1. Permit to use the data exclusively has LLC Easy Market S.p.A.
  2. Personal data shall be used for the following purposes:
    • Delivery of the service and/or product to the Client;
    • Delivery of the Client’s personal information to the third party service providers’ at the moment of the booking or purchase of the travel services through affiliated Travel agent;
    • Informing Client about the new services and products which might be of interest;
    • Personalization of the ads directed towards the Client.
  3. Client agrees that Easy Market can deliver her personal data to the third party only if the law says so or if it is necessary in order to:
    • Respect legal norms and procedures adopted by Easy Market or the website;
    • Act in the emergency situation, if the conditions ask for it, in order to provide personal protection of Easy Market’s clients, website or public.
  4. In any given moment, according to the Article 13 Law Decree 196/2003, Client has the right to:
    • Know his personal data in the possession of Easy Market and how they are treated;
    • Update, integrate, modify or correct personal data;
    • Asks for the conclusion of the personal data use if that use violates any law;
    • Bans personal data use for justifiable reasons or, surely, when data is used to collect commercial information, sending of the promo material, direct sales or market research, by contacting permit owner at: info@easymarketcrs.it

Easy Market uses protected database networks and applies appropriate measures for the protection of damage, unlawful use and change of your personal data in its possession. Access to the mentioned data is allowed exclusively to the authorized people. Easy Market has exclusive role of intermediary for the services and/or products.

Easy Market informs travel agency that it deals only with an intermediation of the scheduled flights which cannot be represented as a typical legal form inside one package, therefore is regulated by the terms and deadlines of the individual service, as it is mentioned in the following text, and needs to be carefully analyzed, in particular, parts about fare rules and baggage allowance.
Booking and/or a combination of the flights and different products and/or services delivered by Easy Market represent freedom of choice of the final client which takes every responsibility coming from the selected combination.
Easy Market under no circumstances is responsible for inaccurate insertion of client’s data during the purchase of the service. It is the client who is responsible for any consequence coming from that error.
When the service booked is a flight ticket, Easy Market represents an intermediary of an airline company for the ticket sale. The tariff is not confirmed until the ticket has been issued. Easy Market under no circumstances is responsible for the obligations on the side of the provider individual products and/or services, but solely for those based on its role of intermediary and in accordance with legal regulation, in particular articles 1, 3 and 6, from 17 to 23 and from 24 to 31 of Law no. 1084 from 27/12/1977 in accordance with International Convention on Travel Contracts (CCV) signed in Brussels on 23/04/1970 (restricted to the parts which do not refer to the contract about sales of packages and until its abrogation by article 3 of Law Decree no 79 from 23.05.2011. – The Law on Tourism) and articles 51, paragraph II, 62 and 65 of Law Decree from 21.02.2014., no 21 Implementation of the Directive 2011/83/EU about Consumer rights, in particular part about passengers’ transport.

Easy Market, as an intermediary, takes no responsibility for full or partial non-compliance with the obligations of a flight, accommodation or other services/products which are part of the contract between the client and provider. Travel agency states and guarantees that Easy Market will not be held responsible and will be released from any responsibility as well as subjects connected with or controlled by it, its legal representatives, employees and partners from any financial liability including legal court expenses which may arise through the use of the services and/or products purchased on the website.

Baggage allowance is never guaranteed by Easy Market and it always needs to be checked directly with an airline whose tariff may not include it in price. In this case it is necessary to check directly with a carrier what is required in order to load the luggage. Authorization and regulation depend upon the airline. With respect to the law, travel agencies do not take Easy Market responsible for any delays, damages or losses linked to the transportation, canceled flights or any other unpredicted event attributable to the airline’s responsibility, with respects to the Regulation 261/04/EC which establishes common rules for the compensation and assistance for the passengers in the cases when boarding is refused, cancelation or extended delays.

Information on the website

Intermediary acknowledges that it will undertake any necessary measure in order to provide updated and right information about airlines and their services. However, the information presented on the website is provided by third parties. Therefore, within the limits of the applicable law, intermediary cannon bi hold responsible for their accuracy.

Travel documents

It is agency’s responsibility to ensure that client possesses personal documents, visas and valid sanitary requirements necessary to enter destination’s country. It is client’s responsibility to respect the laws and regulation of the departure, transit and destination country. Easy Market does not take any responsibility for client’s failure to respect any of these conditions. During the booking phase it is particularly important to pay attention when completing fields with name(s) and surname(s) which must correspond exactly to those in personal documents. Carrier can accept and board only traveler whose name is printed on the ticket.
There is no right to ask for any refund when boarding is not allowed due to the failure to present required documents or if the presented documentation is invalid. The passenger is the only person responsible for the possession of the valid documentation. For the information about the documentation needed to enter different countries we suggest you to consult the website of the Ministry of Foreign Affairs prior to purchase.

Ticket collection, check in and boarding

In order to collect the ticket and finish check in formalities passengers need to present themselves directly at the right check in desk at the airport with valid personal documents. It is recommended to present themselves at least two and a half hours before departure in order to finalize all procedures. Exceptionally, passengers travelling or transiting in the USA are strongly advised to arrive at least three hours before the check in. The reservation shows the departure time of the flight. In the event that a passenger does not arrive in time at the check in desk or at the boarding gate, or is not in possession of the correct documentation or is denied travel, the airline will not be able to accept or board the passenger and will not be able to delay departure. Easy Market does not take any responsibility in the aforementioned cases due to the fact that it is only the passenger who is responsible for the damage or expenses coming from the disrespect of the requirements.

Electronic ticket (e-ticket)

An electronic ticket is sent automatically to the airline/carrier and is identified by the booking code called PNR (Passenger Name Record) which is communicated at the moment the booking is confirmed in a confirmation email sent to the email address indicated by the client during the booking process.

Changes and Cancellations

In case of the need to modify or cancel the flight ticket, travel agency needs to communicate that request to Easy Market by sending e-mail to voli@easymarketcrs.it. After receiving the request, relevant department shall verify whether changes and/or cancellations are allowed for the type of the purchased ticket, with respect to the fare rules communicated by the airline company at the moment of the purchase. If allowed, eventual fees applied by the airline and any price adjustments will be communicated.
Tickets are named documents and therefore non-transferable to third parties. In case that name(s) of the passenger(s) is not correct it may be necessary to cancel the booking and purchase a new ticket. Some reservations cannot be modified. Easy Market is not responsible for any incorrect insertion of the personal name(s).

Cancellation of the ticket issued the same day and change with another PNR

It is agency’s responsibility to verify with flight booking department of Easy Market possibilities of flight cancellation without penalties. In the case of confirmation by our flight department it will be necessary to option new PNR (according to the tariff and terms available at the moment of the booking) and, at the same time, require the emission of new PNR. In that case travel agency needs to write in the “Note” the following text: “I demand cancellation of PNR…” and then put the old PNR which needs to be canceled. Cancellation may be requested by e-mail, as well. Make sure that you have received our response (by e-mail) on your request for the cancellation in order to confirm that PNR is not active anymore. It is crucial to respect this procedure so that there are no mistakes.

Refunds

Authorization of the refund and related timeframe are exclusively responsibility of the airline which has up to a maximum of 12 months from the receipt of the request to process the refund. If the payment was made by the credit card, the amount will be credited directly to the card used to make a booking. If the payment was made by a bank transfer, clients will be contacted by our customer service who will request bank details in order to process the refund. We would like to clarify that agency fees and any insurance are never refundable.

Additional requests

Any additional request such as animal boarding, wheelchair assistance, weapon boarding, sports equipment, unaccompanied minor or any other special request needs to be flagged during the booking or issuing phase. In any case, the request shall be sent to the carrier together with the request for the ticket emission. Airline will decide on the base of its own terms and availability to confirm or not desired service. Before the ticket has been issued, Easy Market will wait for the response of the carrier, so that ticket will be issued as soon as it is confirmed. In some cases airline holds the right to ask for additional fees directly at the airport. If it is not possible to receive confirmation of the request, Easy Market will inform the agency before the ticket has been issued so that it will be possible to choose whether agency confirms ticket issuing or asks for its cancellation.

Unaccompanied minors

Each carrier has its own procedures and rules regarding unaccompanied minors. Usually, a minor must present herself with an accompanying adult who must qualify as such during check in and boarding. The accompanying adult must be at least 18 years old and, if it is not a parent, tutor or the other subject exercising parental authority, must have a relevant permit and travel documents for the same journey as the minor and must travel on the same flight. Easy Market does not take any responsibility for failure to board due to not respecting the rules related to the boarding of the unaccompanied minors. In any case, it is passenger’s responsibility to get informed about terms and special procedures applied by the airline which he/she aims to book or has booked; potential damages and costs arising from a failure to respect the rules related to the boarding of an unaccompanied minor are completely charged to the passenger.

Flight connections

Connecting flights must be used consecutively, failure to board any connection could lead to the automatic cancellation of the whole itinerary without any refund.

Online check-in

ATTENTION: Some low cost carriers ask for check-in to be done only on their own website within a specific timeframe prior to departure. Passengers who do not present a printed boarding pass to the airport security personnel and at the boarding gate will have to check-in again at the check-in desk (if it would be possible) and will be charged an extra fee by the carrier. Airlines which currently ask compulsory online check-in include and are not limited to: Ryanair, Volotea, WizzAir, Bluair.

Electronic ticket (e-ticket)

An electronic ticket is sent automatically to the airline/carrier and is identified by the booking code called PNR (Passenger Name Record) which is communicated at the moment the booking is confirmed in a confirmation email sent to the email address indicated by the client during the booking process.

Ticket emission

Generally, low cost companies use electronic tickets. This means that no paper ticket is printed and that once the booking is finalized you will receive a confirmation mail where the booking reference for your flight will be highlighted. We ask you to print that confirmation and present it together with your personal document at check-in. We remind you that for all Ryanair flights is obligatory to do check-in online on Ryanair website and to print the boarding pass and present it at the airport. Please read carefully notes on their website regarding the time limits for the print of the boarding pass as the penalties are applied in the cases when those deadlines are not respected.

Ticket payment

We inform you that payment for the airline ticket involves two separate transactions. Low cost company will charge the cost of a ticket (ticket tariff, airport taxes, checked luggage charge and eventual card surcharge), while Easy Market as an intermediary will charge service fee and optional travel insurance (if requested). In bank statement you will see two separate charges but the sum of these two will correspond to the total price mentioned in the confirmation mail.

Cancellations

In the most of the cases low cost tickets are non-refundable except when the airline cancels the flight or changes departure time significantly. For more information we advise you to consult terms and conditions of each carrier separately. Passengers who book flight far in advance are advised to reconfirm booking 24 to 72 hours prior to departure by accessing directly to the airline’s website.

Name change

Change of the name is possible by paying a fee imposed by the low cost carrier, in addition to the payment of the difference between the original price and minimum price available at the moment of the change. In any case, change must be asked directly to the carrier.

Date, time and itinerary change

Date, time and itinerary can be changed if there exists availability and the payment of the fee has been made along with a payment of the difference between the original price and the minimum price available at the moment of the change. In any case, change must be asked directly to the carrier.

Security regulation for hand luggage

Since November 6 2006. new security rules are active which limit the quantity of liquid which may be carried through the airport security control. Passengers are allowed to carry only small amount of liquid, gel and cream in hand luggage (max 100 ml per container) and the must be carried in a transparent plastic bag which cannot exceed one liter (approximately 18 x 20 cm). Liquid medicines and dietary products (baby food, as well) can be carried without plastic bag and are not subject to the limitations. In the checked luggage there are no limitations for the liquid. Unaccompanied minors

Each carrier has its own procedures and rules regarding unaccompanied minors. Usually, a minor must present herself with an accompanying adult who must qualify as such during check in and boarding. The accompanying adult must be at least 18 years old and, if it is not a parent, tutor or other subject exercising parental authority, must have a relevant permit and travel documents for the same journey as the minor and must travel on the same flight. In any case, it is passenger’s responsibility to get informed about terms and special procedures applied by the airline which he/she aims to book or has booked; potential damages and costs arising from a failure to respect the rules related to the boarding of an unaccompanied minor are completely charged to the passenger.

Terms and conditions: Hotel, Activities and Transfer

Easy Market has exclusive role of intermediary for the services and/or products.
Booking and/or a combination of the hotel accommodation and different products and/or services delivered by Easy Market represents freedom of choice of the Agency client which takes every responsibility coming from the selected combination.

Hospitality services, as well as activities and transfer, are not represented as a typical legal form inside one package, therefore are regulated by the terms and deadlines of the individual service, as it is stated in the following text.

Easy Market under no circumstances is responsible for inaccurate insertion of client’s data during the purchase of the service.
It is the Agency who is responsible for the consequences coming from that error. When the service booked is hotel accommodation, activity and/or transfer, Easy Market has exclusively the role of the intermediary of different providers of hotel accommodation and additional services.

Easy Market is intermediary as well for the other services and products, classified as additional and optional, so called activities (eg. guided tours, theater shows, sport and recreational events in general, gastronomic services, cultural, etc.) and so called transfers, purchased independently by the client and provided directly by the hotel or by the hotel’s (third) provider, according to contractual conditions which hotel or the third provider communicate to the final client when the purchase is made, due to the fact that it cannot be represented as a typical service in the organization of holiday packages, nor Easy Market takes any responsibility for the acquisition or realization of those activities or transfers.

Easy Market under no circumstances is responsible for the obligations on the side of the provider individual products and/or services, but solely for those based on its role of intermediary and in accordance with legal regulation, in particular articles 1, 3 and 6, from 17 to 23 and from 24 to 31 of Law no. 1084 from 27/12/1977 in accordance with International Convention on Travel Contracts (CCV) signed in Brussels on 23/04/1970.

Changes and cancelations

In the cases of changes or cancelations of the hotel accommodation and/or additional services (activities or transfers), the agency needs to send a request to Easy Market by sending an e-mail to: hotel@easymarketcrs.it.

Once received, department in charge will evaluate if the purchased accommodation, activity or transfer allows changes and/or cancelations.

If confirmed, in accordance with conditions determined by the hotel or service in the moment of the purchase, eventual penalties by the accommodation provider will be communicated.

Refund

When the payment is made with the credit card, refund will be directly to the credit card used, depending on the method of transfer used. The amount will be available on the account two or three months after the request has been made.

In the case when the payment is made by the bank transfer (possible only for the hotel payments), the Agency will be contacted by our client service in order to provide information needed for the bank transfer.

Documents

It is agency’s responsibility to ensure that client possesses personal documents, visas and valid sanitary requirements necessary to enter destination’s country.

Payment of the rent-a-car service

Debit for the service is done through www.revolution.travel website for the whole amount. Payment for any additional service is done at the spot.

Necessary rental documents:

  • Credit card valid at the moment of the booking, issued to the person taking the car and with the sufficient amount of money to cover the payment. Therefore are not valid ATM or debit cards. It is necessary that booking contains the name of the hirer. People not owning a credit card used will not be allowed to rent a car;
  • Voucher for the booking with the booking code will be sent to the e-mail address inserted during the booking phase once the booking has been made. In no more than two days after the booking a client will be contacted by the rent-a-car provider. By following a link provided in that mail it will be possible to check the booking and download a voucher which needs to be printed and presented in the office of the provider;
  • Valid driving license – drivers must possess active driving license for at least one year and must not have been fined for any serious incident in the past;
  • Valid personal document.

Easy Market takes no responsibility for failure to present any of the aforementioned documents or for presentation of a non-valid document.

General terms of the contract

  1. SUBJECT: The general terms presented here define the registration and use of the service Revolution by Easy Market CRS, in further text named Service (or Revolution), which is regulated, besides by these General terms, by the Request to have access for the use of the Service. Users are asked to read legal and technology conditions and information at the website www.easymarket.travel and to ask to receive them directly from Easy Market S.p.A. at any moment. The service provided by Easy Market S.p.A. allows travel agencies, in further text named User (licensed travel agency) to:
    – Use the service and book various offer present, book flights (with existing fees) and low cost flights, with a possibility to independently decide about agency fee;- Use technical support which Easy Market provides at phone number 0541 797 510 (commercial department) or in a written form by mail to sales@easymarket.travel
    Easy Market holds the right to expand and change the gamma of the functions offered inside the service if, in the light of the new features’ specifications, it is necessary to update General Terms or to adjust them. All modifications will be communicated by Easy Market. Easy Market holds the right to change or delete the functions of the services. The user will pay the costs of the connection via phone
  2. DURATION OF THE CONTRACT: The use of the system is free. Registration can be done through the procedure at the company’s website www.revolution.travel and later acceptance of the general terms and conditions with respect to the Law 675/96; acceptance of the Terms and signing of a yearly contract for the use of Revolution. Contract for the use of Revolution is accepted once it is signed and stamped by the agency, followed by the acceptance of the general Terms and conditions (signature and stamp) and the License for the activity of travel agencies and sent to the e-mail address sales@revolution.travel
  3. ACTIVATION AND SUSPENSION: The contract is finalized once Easy Market S.p.A provides the Service based on the acceptance of the terms and conditions by the User. In the case of the technical or normative change of the conditions for the delivery of the Service, Easy Market S.p.A will have the right to suspend the Service with the cancelation period of 15 days, notifying the agency via e-mail to the address mentioned in the signed contract.
  4. CONFIDENTIALITY: Access to the Service is possible by the use of the identification code (User ID), provided by Easy Market S.p.A, and keyword (Password), chosen by the User at the moment of the registration; these credentials will be the only one to be used for all the functions of the Service. Client will protect the password with maximum attention, keeping the confidentiality of the both User ID and password throughout the whole contract duration. The client is asked to keep, with the same confidentiality, the privacy of the other identification elements for any additional service activated. The client is solely responsible for any damage caused by the use of the User ID and password, as well as for the activation of the multiple identities by the third party. The client is responsible to immediately communicate to Easy Market S.p.A. any steal, use or loss of the User ID or password, or any eventual activation of the multiple identities.
  5. GUARANTY: Client guarantees that any material or a message inserted into the public zones of Revolution, and which might be traced back to her due to the contract signed, is solely her own property and/or is on her disposal, and asks from the client to release from any responsibility and protect Easy Market S.p.A from any eventual damage coming from it. Client guarantees that that material does not violate or break any author’s rights, copyrights, brands, patents or any other legal, contractual or custom rights. Client acknowledges that it is forbidden to use or allow the use of the Service against moral and public order or with purpose to interrupt public or private order and peace, to insult, directly or indirectly damages anyone and disturbs the privacy of the private messages. It is forbidden to sell that service to the third parties; in any case client’s information must not contain any pornographic, obscene, blasphemous or shameful content. It is strictly forbidden to use the service which directly or indirectly breaks the laws of the State of Italy or any other country. Accordingly to the following art. 10 and the right of Easy Market S.p.A. to ask for the automatic end of the contract, the use of the Service shall be terminated any time when there is an evidence about the violation of the client’s obligations.
  6. THE USE OF THE SERVICE REVOLUTION: Client is allowed to use the Service Revolution completely free through the registration and according to the specification for each function. Particularly, the function “Access” can be used by the individual Users/Clients/Agencies, there cannot be established multiple connections from different branches of the same agency at the same time but there can be established multiple access from different terminals of the same branch (office). In any case, it is strictly forbidden to pass the contract for the use to the third party, free or with charge, temporary or definitely, without written permission of Easy Market S.p.A.
  7. USERS OBLIGATIONS: User/Travel agency is obliged to use the Service at least during the probation period in order to test all the system’s functions. Easy Market S.p.A. will immediately interrupt the Service in any moment by deactivation of User ID for the access.
  8. . DOCUMENTATION AND IDENTIFICATION OF THE CLIENT:
    When it comes to the functions which ask internet connection, client acknowledges the existence of the electronic register of the Service, filled and kept by Easy Market S.p.A. Log content is completely protected and kept private and is accessible only through the request of legal authorities. In order to confirm with certainty the root of the connection, client accepts the identification which Easy Market S.p.A. makes in the moment of the access into the system by the use of the access code containing User ID and password.
  9. RESOLUTION CLAUSE: In any case when client fails to respect the obligations from the articles 4,5,6 and 7 of this Contract, Easy Market S.p.A will be enabled to terminate this contract and ask for the remuneration for the damage caused.
  10. COMMUNICATION: All notifications regarding the contract are sent to the e-mail address communicated by the client. Easy Market S.p.A. for the Revolution Service: Easy Market S.p.A, Via Consolare 51/c, 47900 Rimini (I); Commercial department: 0541 797 510, Fax: 0541 489 985, sales@revolution.travel , www.easymarket.travel.
    With respect to the article 1341, paragraph II of the Public law, the undersigned confirms knowledge about General Terms and Conditions, in particular point 3. Activation and Termination, point 4. Confidentiality, point 5. Guaranty, point 6. The use of the Service Revolution, point 9. Resolution Clause, General Terms of the Contract.
Ai sensi e per gli effetti dell’art.1341, 2º comma, del Codice Civile, il sottoscritto dichiara di aver preso conoscenza delle condizioni generali di contratto e di accettare espressamente i punti 3. Attivazione e sospensione, 4. Riservatezza, 5. Garanzie, 6. Utilizzo dell’abbonamento, 9. Clausola risolutiva espressa, delle Condizioni Generali di Contratto.

Che cos’è questo documento? Questo documento è l’informativa sui trattamenti dei dati personali relativi al portale www.easymarket.travel e www.revolution.travel

A chi è rivolto questo documento? L’informativa è destinata a tutti i Professionisti del turismo (Agenzie) che interagiscono con il portale

Perché questo documento? Il GDPR (Regolamento UE 2016/679), all’articolo 13 e 14, richiede che Lei (l’interessato) venga informato sui dati personali che vengono trattati e su chi li tratterà, per poterle garantire che il trattamento sia corretto e trasparente. Nel seguito vedrà quindi chiaramente elencati:

  1. chi tratterà i suoi dati (Titolare e Responsabili del Trattamento)
  2. quali dati personali verranno trattati
  3. le finalità con cui saranno trattati i dati personali
  4. per quanto tempo i dati saranno trattati
  5. quali sono i suoi diritti

A quali leggi fa riferimento questo documento? L’informativa è fornita tenendo conto del combinato disposto del:
a) Regolamento Europeo per la Protezione dei Dati Personali (GDPR) UE 2016/679
b) D.Lgs. 196/2003 (Codice Privacy), come modificato dal D.Lgs. 101/2018 e ss.mm.ii

INFORMATIVA

Easy Market spa svolge attività di intermediazione e vendita di servizi turistici alle Agenzie di Viaggio (l’Interessato).

1) TITOLARI DEL TRATTAMENTO

La società Easy Market Spa (con sede in Strada Statale Consolare 51/c 47924 RIMINI Italia, Iscr Reg Impr Rimini, C.F. e P.IVA: 03109340400, Tel: 0541 797510 Fax: 0541 489908.

2) FINALITÀ, BASE GIURIDICA, NATURA DEL TRATTAMENTO E TEMPI DI CONSERVAZIONE

I suoi dati personali sono raccolti per le seguenti finalità:
a. Adempimento di obblighi di legge, regolamento, normativa secondaria:

  • la base giuridica di questo trattamento è la necessità di adempiere ad un obbligo legale a cui è soggetto il Titolare del trattamento;
  • il periodo di conservazione dei dati trattati per questa finalità è la durata contrattuale e, dopo la cessazione, per ulteriori 10 anni e, nel caso di contenzioso giudiziale, per tutta la durata dello stesso, fino all’esaurimento dei termini di esperibilità delle azioni di impugnazione;
  • il conferimento dei dati personali è obbligatorio in quanto vi è un obbligo legale e l’eventuale rifiuto determinerà l’impossibilità a dar corso agli eventuali rapporti contrattuali.

b. Gestione del servizio turistico:

  • la base giuridica di questo trattamento è la necessità di eseguire un contratto di cui l’Interessato è parte o di eseguire misure precontrattuali adottate su richiesta dell’Interessato;
  • il periodo di conservazione dei dati trattati per questa finalità è la durata contrattuale e, dopo la cessazione, per ulteriori 5 anni;
  • il conferimento dei dati personali è obbligatorio in quanto vi è un obbligo contrattuale e l’eventuale rifiuto determinerà l’impossibilità a dar corso agli eventuali rapporti contrattuali.

c. Invio di materiale informativo e promozionale di attività del Titolare del trattamento (newsletter, offerte,…) simili a servizi già resi in precedenza, ricerche di mercato anche in forma anonima (rilevazioni e analisi della soddisfazione del Cliente,…):

  • la base giuridica di questo trattamento è il perseguimento del legittimo interesse del Titolare del trattamento, di cui l’Interessato è parte di un contratto;
  • il periodo di conservazione dei dati trattati per questa finalità è fino a quando l’interessato non chiede di disiscriversi dal servizio di comunicazione promozionale/invio di newsletter.

d. Invio di materiale informativo e promozionale di attività del Titolare del trattamento (newsletter, offerte,…), ricerche di mercato anche in forma anonima (rilevazioni e analisi della soddisfazione del Cliente,…):

  • la base giuridica di questo trattamento è il consenso espresso dall’interessato;
  • il periodo di conservazione dei dati trattati per questa finalità è fino a quando l’interessato non chiede di disiscriversi dal servizio di comunicazione promozionale/invio di newsletter.

3) DATI PERSONALI TRATTATI

Per trattamento di dati personali intendiamo qualsiasi operazione o insieme di operazioni, compiute con o senza l’ausilio di processi automatizzati e applicate a dati personali o insiemi di dati personali, come la raccolta, la registrazione, l’organizzazione, la strutturazione, la conservazione, l’adattamento o la modifica, l’estrazione, la consultazione, l’uso, la comunicazione mediante trasmissione, diffusione o qualsiasi altra forma di messa a disposizione, il raffronto o l’interconnessione, la limitazione, la cancellazione o la distruzione.
Potrebbero essere richiesi anche dati qualificabili, ai sensi dell’art. 9 del GDPR, come “categorie particolari di dati personali” e cioè quei dati che rivelano l’origine razziale o etnica, le opinioni politiche, le convinzioni religiose o filosofiche, o l’appartenenza sindacale, dati relativi alla salute o alla vita sessuale o all’orientamento sessuale della persona. Tali categorie di dati potranno essere trattate dal Titolare del trattamento, solo previo consenso esplicito.
I dati personali trattati sono i seguenti:

  • Dati per l’accesso all’area riservata
    Con la registrazione all’area riservata del portale, il Titolare del trattamento tratta i seguenti dati personali:

    • Informazioni anagrafiche dell’Agenzia di Viaggio [Nome, Cognome (referente Agenzia), Email, Codice fiscale, Telefono fisso, Telefono mobile, Indirizzo sede legale]
    • informazioni anagrafiche del Cliente finale [Nome, Cognome, Email, Data di nascita, Luogo di nascita, Nazionalità, Codice fiscale, Sesso, Telefono fisso, Telefono mobile, Domicilio, Residenza, Estremi documento di identità, disabilità, patologie, religione]
  • Dati per l’iscrizione alla newsletter
    I dati personali trattati per la registrazione alla newsletter, sono i seguenti: Nome, Cognome, Email.
  • Dati di navigazione
    I sistemi informatici e le procedure software preposte al funzionamento di questo sito acquisiscono, nel corso del loro normale esercizio, alcuni dati personali la cui trasmissione è implicita nell’uso dei protocolli di comunicazione di Internet.
    In questa categoria di dati rientrano gli indirizzi IP o i nomi a dominio dei computer e dei terminali utilizzati dagli utenti, gli indirizzi in notazione URI/URL (Uniform Resource Identifier/Locator) delle risorse richieste, l’orario della richiesta, il metodo utilizzato nel sottoporre la richiesta al server, la dimensione del file ottenuto in risposta, il codice numerico indicante lo stato della risposta data dal server (buon fine, errore, ecc.) ed altri parametri relativi al sistema operativo e all’ambiente informatico dell’utente.
    Tali dati, necessari per la fruizione dei servizi web, vengono anche trattati allo scopo di:

    • ottenere informazioni statistiche sull’uso dei servizi (pagine più visitate, numero di visitatori per fascia oraria o giornaliera, aree geografiche di provenienza, ecc.);
    • controllare il corretto funzionamento dei servizi offerti.
      I dati di navigazione non persistono per più di 365 giorni e vengono cancellati immediatamente dopo la loro aggregazione (salve eventuali necessità di accertamento di reati da parte dell’Autorità giudiziaria).
  • Dati comunicati dall’utente
    L’invio facoltativo, esplicito e volontario di messaggi agli indirizzi di contatto del Titolare del trattamento, comportano l’acquisizione dei dati di contatto del mittente, necessari a rispondere, nonché di tutti i dati personali inclusi nelle comunicazioni.
    L’utente ha la facoltà di registrarsi al portale per usufruire nell’area riservata dei servizi offerti dal Titolare del trattamento.

4) DESTINATARI DEI DATI PERSONALI

I suoi dati personali potranno essere condivisi, per le finalità di cui sopra, con:

  • soggetti che agiscono tipicamente in qualità di responsabili del trattamento ossia persone, società o professionisti che prestano attività di assistenza e consulenza al Titolare in materia contabile, amministrativa, legale, tributaria, finanziaria e di recupero crediti relativamente alla erogazione dei servizi;
  • soggetti con i quali sia necessario interagire per l’erogazione dei servizi;
  • soggetti, enti od autorità a cui sia obbligatorio comunicare i suoi dati personali in forza di disposizioni di legge o di ordini delle autorità;
  • personale espressamente autorizzato dal Titolare del trattamento, necessario a svolgere attività strettamente correlate all’erogazione dei servizi, che si siano impegnate alla riservatezza o abbiano un adeguato obbligo legale di riservatezza e che abbiano ricevuto adeguate istruzioni operative;

5) TRASFERIMENTO DEI DATI PERSONALI

Alcuni dei suoi dati personali sono condivisi con destinatari che si potrebbero trovare al di fuori dalla Unione Europea. Il Titolare assicura che il trattamento dei suoi dati personali da parte di questi destinatari avviene nel rispetto del GDPR. Invero, i trasferimenti si possono basare su una decisione di adeguatezza o sulle Clausole Contrattuali Standard approvate dalla Commissione Europea. 6) ESISTENZA DI UN PROCESSO DECISIONALE AUTOMATIZZATO, COMPRESA LA PROFILAZIONE

Il Titolare del trattamento, al fine della conclusione o dell’esecuzione del contratto, adotta un processo decisionale automatizzato sul trattamento dei dati personali, compresa la profilazione, di cui all’articolo 22 del GDPR finalizzato alla personalizzazione del listino in base alla provenienza dell’Agenzia di Viaggi.

7) DIRITTI DEGLI INTERESSATI

Gli interessati hanno il diritto di ottenere dal Titolare del trattamento, nei casi previsti, l’accesso ai dati personali e la rettifica o la cancellazione degli stessi o la limitazione del trattamento che li riguarda o di opporsi al trattamento (artt. 15 e ss. del GDPR). L’apposita istanza al Titolare è presentata contattando l’email preposta per il riscontro all’interessato.

8) DIRITTO DI RECLAMO

Gli interessati che ritengono che il trattamento dei dati personali a loro riferiti avvenga in violazione di quanto previsto dal GDPR, hanno il diritto di proporre reclamo all’Autorità Garante per la Protezione dei Dati Personali (www.gpdp.it), come previsto dall’art. 77 del GDPR stesso, o di adire le opportune sedi giudiziarie (art. 79 del GDPR).

9) MODIFICHE
